There is recent precedent.

Donald is just using the children as hostages for his own agenda and cruelty.

Even some prisons allow mothers to keep their newborns as they grow.

1. When the parents are offered deportation with their kids.
2. Family detention centers, which are few in number.
3. Not detaining them but just cutting them free and expecting them to show up for a court case at the end of which they might be deported.

For 1, parents have been choosing detention.

For 2, Congress has routinely denied funding.

For 3, there are numbers showing that most court appointments in the appropriate administrative court are kept, i.e., the people show up, but I haven't seen any breakdown for how many of those fall into the various available categories--those who are well along in their claims versus whose whose claims are very likely going to be dismissed being near the two extremes.
