Michael Avenatti Threatens to Sue Daily Caller for 'Defamation'

Michael Avenatti, the lawyer who is representing Stormy Daniels in her legal battles against President Donald Trump, threatened to sue The Daily Caller and its reporters for “defamatory statements” in an email sent Monday morning. “Let me be clear. If you and your colleagues do not stop with the hit pieces that are full of lies and defamatory statements, I have no choice but to sue each of you and your publication for defamation. During that process, we will expose your publication for what it truly is,” he wrote. “If you think I’m kidding, you really don’t know anything about me. This is the last warning.” Avenatti also attempted to keep the unprompted email off the record by writing “Off the Record” at the top. Avenatti has been making regular appearances on cable news shows and has an active Twitter presence.

1. If they've already published "lies and defamatory statements" why isn't he suing already?

He has told them that the statement is defamatory. If it had not already, this was the media outlet's chance to investigate to determine its basis in fact. If it is not well-founded in fact, then they would have to retract it to avoid liability.

in keeping his name on top on of the news headlines.

He can sue them at any time or concurrently with his suit for Daniels, but any judgement would be months in the making. By adding, “Off the Record”, Avenatti guaranteed that The Daily Caller would take the bait and rush to publish his tweet. He's playing a three dimensional Vulcan Chess game and his opponents are struggling with tic-tac-toe.
