His hands are pretty dirty in this whole debacle. Why is Mueller allowing him to represent Trump?
I hope it doesn't mean that Guiliani is NOT in Mueller's sites. That would be such a huge disappointment to me.
Any ideas??

Remember that DiGenova and Toensing represented Trump for about an hour and a half? It was either speculated or reported that Mueller told them they couldn't since they represented someone who's a witness.
So, if he's looking at ANYTHING about Guiliani (and he should be), I don't know Guiliani can be Trump's attorney.

(6,913 posts)Mueller has absolutely no role in choosing Trumps attorney or authority to dismiss Trumps attorney.

(62,444 posts)Thrill me to this theory that the prosecutor gets to decide whether a licensed attorney may represent a client.

(11,107 posts)If I were Guiliani, I would be asking myself if there are questions Mueller wanted to ask me. It's clear a lawyer cannot appear as counsel and witness in the same case.

(14,985 posts)and I expect the conflict will eventually manifest itself in court filings.
I doubt Rudy will ever put his name to any court filing or appear as counsel in any hearing on this matter. I suspect his role to be more sideline advice and trying/failing to schmooze Mueller's people.
In any case Mueller can't dictate who does/doesn't represent Trump. Imagine a criminal justice system where a prosecutor could choose/veto a defendant's lawyer.
That being said, my understanding is that as a general standard a prosecutor has a professional ethical obligation not to ignore when a defendant has a clearly conflicted defense counsel. Once the prosecutor raises the issue with the defendant and they choose to proceed anyway, now that's on the defendant. Of course the conflicted defense counsel would still have to answer to the bar for any inappropriate action on their end. But maybe he'd risk the ire of the bar and act totally unethically anyway. I'm not sure Rudy needs or cares about an active law license since he seems to be more a lobbyist/consultant/pundit than lawyer.
Also I could be totally wrong about everything b/c most of what I know about law I learned from podcasts.

Team Mueller knows who the Players are, and,it takes time to put cases together in order to take these Players out of the game.

(34,661 posts)And that is what he is up to . Remember,Team Mueller most likely has the names and rank of every outlaw Agent in the NYC FBI Field Office.
Appears we are seeing a Foreign Espionage Case Building, and know one is uttering Treason at this Point in time.
About a week ago,one of the Major Print Reporters mentioned this,Mueller is using a 1948 Statute in charging people so far. Crimes against the United States. Do recall it being used in and around the McCarthy era.

(34,661 posts)Rudy is showing his true intent. Noticed he is attacking Comey, calling him a embarrassment to the FBI . As I mentioned, just throwing garbage and seeing what sticks to the wall.
Again, you mess with the Agencies and the Agencies will balance the books.

(115,806 posts)If for some reason Giuliani becomes a witness, or more than that, he will not be able to represent Trump in court but that has to do with lawyers' rules of professional conduct.
