When you take a loan from a bank, you have to disclose why.

If you take $130,000 HELOC, then transfer it to a corporation, then transfer it for a NDA, that's going to be fraud unless he disclosed to the bank on his original HELOC application that he was paying for an NDA.

Idiot could have gotten the funds elsewhere.

Use it for (this, that, whatever you WANT!).

So I'm not sure what you're saying is correct. It's basically a collateralized (sp) loan.

Though if he took out more than (whatever is the limit) % of his homes value and made a portion of it a 'personal or business loan', essentially, that would be different.

Or maybe the HELOC is actually a lie ... aren't we basically relying on his word on that?

4. On the application, there is a question

That says purpose of loan. On almost every application they ask you the purpose.

(Look at more than the first link)

You can use the money for what you want, but if the bank asked you the purpose of the loan and you lied, then transfer the money to another bank for a different purpose, that is going to be bank fraud and money laundering.

If he was truthful on the application, I don't see a problem. But I wonder what he typed.

disgraceful. And they dare to pretend they have some sort of "moral superiority" because they toss out cartloads of hypocritical horseshit about religion which they obviously do not believe, since they do not follow any respected religious precepts from any decent religion.
