New York lawmakers passed a bill Thursday that bans police officers from having sex with people in custody, the New York Daily News reported.
The bill, which says that detained people are unable to consent to sex, would close a legal loophole that let police officers avoid sexual assault charges by saying sex with people in custody was consensual.
Last month, BuzzFeed reported that many states do not have laws explicitly defining sexual contact between officers and detainees as nonconsensual. At least six states have passed bills to change such laws.

My own first thought was "What's wrong with the old one?" Because surely this was made illegal long ago. Then I remembered NY's nasty not-so secret. NO old one -- that's the shocker.

(36,827 posts)This behavior goes on everywhere and has been since people have been put into custody.
We have laws preventing people from consuming certain plants and fungi, but not for custodians raping their wards.

The police could coerce consent. Maybe arrest somebody and offer to let them go or treat them better if they put out.
Or the police could arrest somebody and the person arrested could offer sex in exchange for dropping the charges or maybe hiding evidence.
We'll only really hear about the first.

(7,638 posts)Let's get them to pass a law that you can't shoot people that are in custody. Maybe we can correct behavior with a gazillion laws. Or maybe just hire public servants that aren't so fucking stupid?
