As the panel members were discussing Trump's legal strategy, Judge Napolitano said that moving the case to a federal court was a mistake. And since the Supreme Court decided in the 90's that the Paula Jones case could survive summary judgment, his prediction was that Trump, like Clinton before him, would be deposed.
Napolitano said, "when Michael Cohen negotiated the agreement, according to Stormy Daniels, he claimed he was not representing the president. now the agreement purports to protect the president. bottom line, as Kennedy just said in the intro, the Supreme Court ruled 9-0 in Paula Jones versus Bill Clinton, the motion survived the motion to dismiss."
He continued, "the president has to participate in litigation. Will Stormy Daniels's lawyers get to depose Donald Trump on the validity of this hush money agreement? My prediction? Yes."
Trump supporters better brace themselves. Trump can't "plead the fifth" in a civil case. But he can perjure himself. And that could lead to an indictment....................

He'll pay it, just so he can put it behind him. He's not going to give a deposition in this case or speak to Mueller either.

(3,194 posts)Something to the effect that he would be willing to settle, but he did not elaborate. It was the 1st time I've ever heard him say that word, so it surprised me.
I think he will pay to avoid giving a deposition under oath. And whatever it is that she has, perhaps it is worth it to him. Maybe what she has is more significant than what these other women have.
It's not like he doesn't have the money to pay her to go away. I just hope that's not an option, and that Stormy is only interested in telling her story, not simply getting more than the $130K she got, plus the 60 Min money.
If she is asking for $$$ now, it's probably in the 7 or even 8 figures. Again, it depends upon what she appears to be holding back.

(82,849 posts)I'd guess that Trump will file a motion to dismiss. If that fails, documentary discovery (probably subject to a stipulated protective order so that outsiders like us don't see anything) will be exchanged. Trump will then file a motion for summary judgment. If that fails to dispose of the case, then they'll move on to depositions.
My timeline guess: Motion to Dismiss, briefed, argued and decided by the end of April. Documentary discovery will take about 90 days, which means the beginning of August. Motion for summary judgment filed by mid-August, briefed, argued and decided by the end of September, first part of October. If the case survives that motion, then they'll start working on the scheduling of depositions. There's an outside chance depositions could happen within six or seven weeks, but more likely they'll be put over to the new year.
TL;DR: Don't look for depositions to be scheduled until early next year.
