A word about Nunberg and the GJ subpoena

As someone who frequently handles subpoena compliance, there are a few things that strike me here.

Often, in a criminal investigation, the subject will be informed that communicating the contents of the subpoena in such a way as to compromise the investigation can constitute a criminal offense.

So, if you are subpoenaed about Joe, then you don’t ring up Joe and say “Hey, they want to ask me questions about you.”

Notice that Nunberg made a number of claims about what is in the subpoena, but didn’t provide a copy to any of the news organizations. He did keep mentioning a particular date - November 1, 2015 - but he also said the subpoena was about a date range.

He also made sure that Erin Burnett would smell alcohol, and then said he was taking anti-depressants.

If he wanted to make a point about how broad the subpoena is, why didn’t he let anyone else read it, why would he keep mentioning a single date, and why would he behave in a fantastically erratic manner to lead people to believe he was not in control of his faculties?

IMHO, there is a simple answer to all three questions.

why he kept repeating on Jake Tapper that he didn't want to spend 30 hours reviewing his emails to give them to Mueller. Makes me think he wast tanked.

November 1, 2015 is the start date for producing the documents - they want all documents from that date to the present.

Ari Melber said he didn't smell alcohol on him, and John Heilemann said he's always like that. So I have no idea what's going on. It's bizarre.

As for this guy, as I pointed out in another post, prevalence of personality disorders among Americans has been measured at 9.1%. That's 1 out of every 11 people we've ever known. The various obsessive types, the suspicious schizoid types, the lying, manipulative, troublemaking types. Basically, the sort people always talk about, wondering what on earth made them "behave that way."

That's a lot of people. Plus, a lot more people merely display strong traits of without being severe enough to be diagnosable, and there are, of course, other mental disorders.

I suspect mental disorder of some type is what a lot of people were seeing displayed today. The other thing people wonder is why "they" don't just stop it because they're going to get fired, in trouble with the law in this case, etc., and the answer is that they can't, which is a huge clue to an actual disorder.

And at one point he said the subpoena period covered November 15 to the present.

Also, he showed the subpoena to the Washington Post reporter.

But I agree with what I think you're saying. I think he went public with this as a way to warn the people on the list. And he made himself act like an alcoholic nutcase to destroy his credibility as a witness for either sides.

That is in my opinion more likely than alcohol or drugs.

If alcohol or drugs are involved, it may be because he uses them to help him deal with stress.

I did not notice that his speech was slurred. Did you? Maybe I just missed it.

slows people down rather than speeding them up.

rules out use of alcohol and/or drugs. His speech was not slurred on either of the two separate shows I watched his interviews on, Tappers' and Hayes' later. And part of Melber's.

I'm thinking he wants to eat his cake and have it, too. IOW, he's going to yakk to Mueller but make everyone think he's telling them, "go pound sand."

This way, he can rat out the GOP et al and avoid jail time; i.e., "See you guys! I told 'em nuthin'!", while keeping his BFF buddy-boy relationship with Roger Stone.

So yeah, IMHO all this "I ain't sayin' shit" bluster is bs. I call bs! lol
