(52,241 posts)If its all in the past and the contempt offense is a done deal, then sure, it can be pardoned.
But if its an ongoing thing, like youre in contempt until you produce the document or until you answer all the questions, Im not sure a pardon really works.
You cant pardon future or ongoing crimes.
Unless Donnie wants to keep pardoning him every day....

(52,241 posts)first, he only waives his fifth amendment rights if and when he formally accepts a pardon in court. it can't be forced on him.
in practice, a prosecutor may not bother building a case if he knows the accused has a pardon in hand and then the person pardoned never needs to formally use it.
on the other hand, if the prosecutor might start to try the case just to make him use the pardon to avoid this problem.
second, a pardon from donnie would only removes jeopardy for specific federal crimes in the past. it wouldn't protect him from state level crimes or from future or ongoing federal crimes. that means that he may still have some fifth amendment rights.
for instance, say donnie pardons him for any federal income tax evasion he might have done. well he could still avoid testifying about anything about the tax evasion scheme if that might violate state income tax laws as well.

Shock, sensationalism, to dominate the news as distraction for the real horror show occurring away from the eyes of American citizens.
That's the part we should be watching.

after i posted that lats night, I thought about it a bit more. If Nunberg was sent out as a distraction, he succeeded in getting the news coverage. However, he also admitted on air that Trump knew about the Trump Tower meeting at least a week in advance. Everybody has been saying all along that Trump knew nothing about the meeting and wasn't involved. The only one that said otherwise was Bannon in the Fire & Fury book. That's not exactly how I'd want things blown up if I were Trump.
