Trump Lawyers Trying to Limit Time with Mueller
February 25, 2018 at 7:30 pm EST
By Taegan Goddard

President Trump’s lawyers “are considering ways for him to testify before special counsel Robert Mueller, provided the questions he faces are limited in scope and don’t test his recollections in ways they say could unfairly trap him into perjuring himself,” the Wall Street Journal reports.

“Mr. Trump’s legal team is weighing options that include providing written answers to Mr. Mueller’s questions and having the president give limited face-to-face testimony.”

Euphemism of the day: “Mr. Trump is a freewheeling conversationalist, an instinct that proved advantageous on the campaign trail but could be unsuited to a legal setting.”

This isn't a perjury trap. A perjury trap is when a prosecutor engages in misconduct to secure a charge against someone who hasn't otherwise broken the law. See for example Kenneth Starr, pinning down President Clinton on each and every aspect of his conduct with Monica Lewinsky. Whatever Clinton and Lewinsky did, it wasn't against the law; no crime was committed. But if Starr could get Clinton to lie, or shade the truth, or be evasive enough, he could and did charge Clinton with lying under oath. The proof of the perjury trap misconduct by Starr is that none of the charges against Clinton stuck in the subsequent legal proceeding, indeed, none of them even got a majority vote, much less the super-majority required for removal from office.

Trump isn't being lured into a perjury trap; the guilty pleas by others involved are the proof that crimes have been committed. There is no question that this is a legitimate criminal investigation. Don't buy this "perjury trap" nonsense. It's seeding of public opinion by Trump's lawyers, who are counting on general public ignorance of criminal proceedings to advance a bullshit witch hunt scenario.

And no legal rules are followed. It is a political proceeding. Clinton did lose his law license after a hearing on the facts which Starr had no role. It is ironic that you imply that perjury traps are not a problem and then you claim Clinton was caught up in one.

Clinton was NOT in any danger of a criminal prosecution. What he was eventually accused of doing - diddling around with Monica Lewinsky - is not and was not a crime. Kenneth Starr called him in to testify under oath, asking Clinton questions that were designed to cause him to lie, or otherwise make a colorable claim of perjury, which is a criminal offense.

Mission accomplished, because the House impeached Clinton and brought the charges to the Senate for adjudication. The Senate failed to convict on any of the charges that grew out of the perjury trap that Starr tried to set for Clinton. A perjury trap is prosecutorial misconduct, designed to get a criminal conviction for perjury out of conduct that is not itself criminal. What Mueller's team is investigating is indeed a crime, as evidenced by the guilty pleas entered by some of those involved.

No one made Clinton lie. He lied In front of federal judge Susan Webber Wright during a deposition. Not Ken Starr. Judge Wright waited until the impeachment trial was over before finding him in contempt of court. That’s why he paid an enormous sum of money in fines and penalties. That’s why the Arkansas Supreme Court took his law license away for a period of time, and that’s why he resigned from the United States Supreme Court Bar because he didn’t want them taking his law license away either.

Bill Clinton had a right to a trial in Little Rock, Arkansas, him versus the court, where the court would provide her information, Judge Wright would provide her information for holding him in contempt, the reason she held him in contempt, and Bill Clinton free to defend himself. He choose not to have the trial.

So far Mueller has not gotten any guilty pleas relating to the substance of the Russia investigation. The guilty pleas have been process crimes of lying to the feds or crimes that occurred well before the 2016 election.

“People don’t understand, I went to an Ivy League college. I was a nice student,” Trump told reporters. “I did very well. I’m a very intelligent person.” Later, pointing to his head, he added: “One of the great memories of all time.”
