Said Toomey: Look, I think its inevitable that that conversations going to take place. I think state House members and state senators are going to be speaking amongst themselves and their constituents, and the fundamental question is does this blatant, unconstitutional, partisan power grab that undermines our electoral process, does that rise to the level of impeachment?

I'm not talking Civil War level stuff, but a large number of them and their supporters will never respect the results of Democratic and fair elections.
Not saying I hope for that, but we'd better start preparing for the inevitable. Some are going to have to get the message by force.

(6,474 posts)I'm an appellate attorney and generally courts of appeal reject an action if you fail to exhaust your administrative remedies. Republicans remedy is to pursue an appeal. Until they establish that the Court did not rule on legal grounds, then any pre-textual ground which could have been appealed such as the Court applied incorrect analysis is not likely to withstand review. The Pennsylvania Court's decision is the "law of the case" and presumed correct. Failure to exhaust administrative remedies (ie appeal) is generally a requirement relied on by conservative justices. In fact, that SCOTUS decision today with regard to requiring pursuit of whistleblower actions through the government agency is based on this same general concept-and the decision was unanimous.
