Remember. It's a "memo". Not a document of fact.

The background is the evidence. "Take a memo. I did not rob the bank. There was no bank nearby to rob. I would have to drive miles to rob that bank. That bank that you are referring to, that you say I robbed, is just your opinion"

It's not being offered for the truth of the matter asserted at this point.

It's being offered as a tactic to quelch an investigation into criminal misconduct by the President of the United States and those under him.
