(12,344 posts)This was always the weakness of Obama's reliance on executive action. Whatever he did without Congress could be undone by the next President. There is a good chance the SCOTUS will see it that way.

(6,139 posts)not to mention Obama himself stated that DACA was likely unconsitutional and so it was meant to be a temporary measure. I bet SC will issue a unanimous ruling which will set no new precedent as it would not be a ruling on constitutionality of Obamas EO but merely stating that a new president has the authority to cancel previous presidents EO for any reason - no brainer really. Obama cancelled a bunch of Bushs EOs as soon as he reached the WH.

The Constitution says all legislative power rests with the congress. So it isn't legislation. It's just guidance by a President on how to interpret a law. That interpretation can't be immortal. Each administration will interpret it as they see fit.

(5,455 posts)An EO signed by one president can be reversed by a successor, additionally immigration is something the Federal government determines, either by laws Congress passes or by EO of a president.
