Despite registering a blood-alcohol level of 0.15, nearly twice the state's legal limit, Carlsbad State Assemblyman Martin Garrick claimed he had consumed only about three glasses of wine when he was arrested for driving while intoxicated in Sacramento on June 15, according to a California Highway Patrol arrest report.

The Republican lawmaker told arresting officers that he drank the wine with dinner at a friend's house and denied feeling intoxicated, said the report, released this week.

Officers on bicycles patrolling the grounds around the Legislature that evening said they saw Garrick speed through two red lights and a stop sign before ducking into a garage beneath the Capitol.

The report says Garrick ignored the arresting officer when he was approached, instead walking to the passenger side of the state-owned silver Camry.

The 58-year-old Garrick repeatedly told the officers he was having "severe stomach pain and diarrhea and told the officers he didn't see them when asked why he had ignored their commands to when first spotted.

The officers then formally arrested Garrick and took him to the Sacramento County main jail for a breath test.

When they arrived, Garrick reported having severe stomach pains and then vomited several times, the report says.

Rather than book him into jail after the breath test, the officers released Garrick to an employee of the Assembly Special Services Unit for what they said was a possible exam at a local hospital.
