1. The answer to your question is Yes, I believe.

Something that just occurred to me is to wonder if the appointment would need Senate approval (parallel to a Federal appointment). If so, and if the recall elections go correctly, Prosser's appointment could end up facing a Democratic Senate.

He denied "anonymous claims made to the media." There could be a big difference. Some of the claims made against him were by the person he is alleged to have assaulted, and those claims were not anonymous.
