1. Just Indict and arrest Clarence Thomas. The rest will take care of itself.
Let a Grand Jury do the investigation.

11. Can only be indicted by the House of Representatives
He can only be impeached. He can not be arrested nor tried, except by the full Senate. The SC Justices can only be removed from office the same way a President is.

12. Absolutely untrue. Many Federal Judges have been indicted, arrested and tried before impeachment
Where is this crappy disinformation coming from?

Here are articles about a federal judge who was indicted in 2008:

13. SC Justices are not merely Federal Judges
Hey, I'm all for just locking the bastard up. However, I do believe that a Supreme has never been indicted, although there has been one impeached I think.

I would love to be wrong on this. Any legal opinions, links, etc?

14. There was a Supreme Court Justice arrested and charged w/ murder in 1889
Edited on Sun Jun-26-11 01:34 AM by leveymg
Justice Field was pardoned by the Governor of California (state charge) but his bodyguard's case made it all the way to the Supreme Court. There was never an issue raised about whether a sitting Judge, SC or any other, can be prosecuted. The Court found the bodyguard, who shot a US Senator who was trying to kill Field, had acted properly pursuant to his official authority as a US Marshal. Politics was still a serious blood sport in the decades after the Civil War.

16. I agree with you!
Arrest and indict Clarence Thomas! The SC Justices are too powerful as it is with their lifetime appointments. They should not be above the law as well. Arrest him for bribery. They do it to Congressmen and other judges, so, they are fair game.

18. The appropriate charge is False Statement, 5 USC App. 104, 1 yr imprisonment, $50K fine each count
Five counts. Clarence goes up the river. He never hears another case.

17. Good post title but it's followed by a very wrong and unjustifiable reason.
If he should be removed it's because of his improper behavior alone. You can't justify it as a effort to shift the Supreme Court majority to the left. Your heart's in the right place but if you were to read a similar argument about, say, unseating a Democratic Senator to help shift the Senate to the right, you'd readily realize how invalid and objectionable such a position would be.
