Is it 60 votes or 60%? Thanks.
Sometimes these thresh-holds are a percentage of those present, assuming those present constitute a caucus.

Anyone know if the cloutre rule is a flat 60?

1. My understanding, at least during "NuclearOptionBonanza" of 2005-06
Was that the criteria is 3/5ths of the Senate present and voting.

That would mean that if one pug is missing we need only 59, and so on. (If my math is right)

Depends on the rounding.

3/5 of 99 is 59.4

That would be 59 for most purposes but I am going to guess that normal rounding doesn't apply in senate rules.

But with 98 present the number would definately be 59. (=58.8)

60 votes is a hard number in a 100 person Senate, regardless of how many senators are present.

15. I guess in all these mathematical calculations, I should probably remind you all
Robert Byrd hasn't been showing up a lot lately either. So that means we're starting at 59 even before we subtract Lieberdouche, Nelson, and the rest of the treasonous cowards.

Maybe Byrd will make it in for the vote or maybe not, I honestly haven't been following his health closely. But he's obviously not up to working often these days, so I wouldn't count on him being there.

17. Rule 22
• The majority required to invoke cloture is three-fifths of the Senators duly chosen
and sworn, or 60 votes if there are no vacancies in the Senate’s membership.
However, invoking cloture on a measure or motion to amend the Senate’s rules
requires the votes of two-thirds of the Senators present and voting, or 67 votes if
all 100 Senators vote.
