Idiot lawsuit of the day
Doctor Sues Restaurant For Letting Him Eat a Whole Artichoke
Wednesday, November 17, 2010, by Raphael Brion




A doctor in Miami, Florida is suing the Hillstone Restaurant Group, parent of the Houston's Restaurant chain, after having had a bad experience with an artichoke there. Apparently Arturo Carvajal ordered the off-menu special of "Grilled Artichokes." And then he ate the entire thing, leaves and all.

According to the legal complaint via the Miami New Times, he suffered "severe abdominal pain and discomfort," was admitted to the hospital and an "exploratory laparotomy was performed where artichoke leaves were found lodged within small bowell ." Oh dear. He's suing for an unspecified amount for "bodily injury, resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical and nursing care and treatment, and aggravation of pre-existing conditions."

The Lawsuit alleges that the server never asked if Carvajal knew how to eat an artichoke and that the restaurant had a "duty to train its table servers to explain the proper method of consuming an artichoke." The restaurant chain's VP and general counsel feels bad that he want to the hospital, but said, “It's just kind of a silly notion... What's next? Are we going to have to post warnings on our menu they shouldn't eat the bones in our barbeque ribs?”

1. I honestly had no idea what parts of an artichoke you should eat. Of course,
I would never have ordered one to begin with.

4. I introduced my husband to them.
There are basically three parts. If you steam them, you peel of the petal (leaf, whatever) one by one and scrape off the soft part at the large end of each leaf with your teeth. (We use a curry mayo as a dip.) Once the leaves get too small, you can scrape away the last few leaves and carefully scrape the "choke" part, which looks like a bunch of fine protective hair. Then you have the best part, which is the base (not the stem).

First time dh tried one, I totally forgot to tell him not to eat the "choke". However, he didn't sue me.

And seriously, I am wondering how he even chewed and swallowed the leaves. They're very tough.

Really??? You've never seen or heard of an artichoke before? What the fuck rock are you living under?

But I appreciate the right-wing "we need tort reform" Story of the Week.

6. Probably the same entity that gave the incompetent
medical resident who couldn't even perform a comprehensive blood test (aka a bone biopsy, a routine, simple procedure any second-year student should be able to perform cleanly and routinely) on my best friend, nicking an artery and causing arterial blood to leak internally and severely damage major organs, causing her months of hospitalization and severe suffering before she finally died nearly a year later, her medical degree, as well as the idiot attending doctor who, along with the resident, did nothing to correct the issue until many hours later, too late to correct the damage.

Yet, they fought the very legitimate malpractice suit tooth and nail despite hospital and medical records clearly showing their egregious error, and tried to smear my friend, who'd previously fought cancer and won only to fall victim to inexcusable medical incompetence and negligence. And RW motherfuckers insist on "tort reform" to protect the medical profession from any accountable for their negligence. Until it happens to THEM, of course. I'll bet ya dollars to doughnuts that this idiot doctor (and does anyone believe for one second that he'd never even heard of an artichoke before? COME. ON.) is on the "tort reform" bandwagon, freaking hypocrite.

Those buggers are TOUGH. There's a reason they hang together so well when you scrape the good stuff out with your teeth.
