The Honorable Patrick Leahy
Chairman
Committee on the Judiciary
United States Senate
Washington, DC 205 15
Dear Messrs. Chairman:
This supplements our previous responses to your letter requests and the House Judiciary
Committee's subpoena concerning the Committees' oversight investigations regarding the
resignations of eight U.S. Attorneys.
During the past several weeks, the Department has provided logs relating to documents
that have not been produced because they relate to our efforts to respond to congressional and
media inquiries following the resignations of the U.S. Attorneys. We have, of course, produced
certain records based upon our concern about possible inaccuracies in information that was
provided to your Committees regarding this matter after the resignations. We have substantial
confidentiality interests in the remaining documents in this category because we do not want to
chill the internal process, including the exchange of candid views, that is essential to our
development of responses to congressional and media requests for information. Accordingly, we
have produced logs of documents for your review and we met with House Judiciary Committee
staff about the logs of documents derived from Ms. Goodling's records on May 18,2007. In the
course of that discussion, Committee staff articulated particularized needs for certain of those
documents, pursuant to four categories of priority. Enclosed are the documents we discussed that
were particularly requested by staff as first priority records, with minimal redactions of personal
and other information in line with our past productions. Also enclosed are additional documents
that were either inadvertently not produced or which we have now determined are appropriate for
disclosure.
The Honorable John Conyers, Jr.
The Honorable Patrick Leahy

We are continuing to review documents identified in priority categories two through four
and we will supplement this response whenthat process is completed. We hope that this
information is helpful and appreciate your engagement in the accommodation process relating to
these records. Please do not hesitate to contact this office if you would lilte additional assistance
regarding this or any other matter.
Sincerely,
Richard A. Hertling
