How is refusing to offer children's insurance policies ( to evade the new statutory
requirement that companies insure children's pre-existing conditions) not age discrimination?

I'm sure there is demographic information that would pinpoint the age range at which the most expensive health insurance claims are filed. If these admirable "corporate citizens" can simply refuse to insure kids, why can't they exclude, say, 55 to 65 year olds?

1. Are parents not required to cover kids, same as mandatory coverage for adults?
I imagine the parallel is that if adults can't be denied for preexisting conditions because they must have coverage or be fined then the opposite must be true for kids where there is no mandate they be covered thus no preexisting waiver for them. And because they can't discriminate based on age they will simply refuse stand alone child policies, ergo they can only be included on a family plan.

7. Yes but kids can't file their own income taxes and be fined for lack of insurance
Whereas an incompetent person still has obligations and is mandated to have coverage.

15. I'm just guessing that is the difference.
But when I was against the mandate people here insisted it was necessary or people would game the system. The only reasons I can see for allowing the dropping of kids policies is the same rationale of it not being mandatory and therefore open to being gamed.

12. Refusing to provide health care for children is a crime.
Parents who do not give proper care for or provide for the care of their children are committing a crime in most states if not all of them.

Refusing to allow coverage for health care to children by the Health Care Insurance Companies is abetting the neglect and abuse of children and is a criminal offense.

All CEOs and officers of these corporations should be arrested and prosecuted for child abuse crimes and be registered as child abusers.

19. Thye CAN exclude 55+ year old Americans.
There is NOTHING in the new health legislation that would prevent a company from only offering covereage to people between the ages of, say, 18 and 35. In fact, given the healthcare mandate for younger people, that would actually be one heck of a business opportunity. Start an insurance company that only covers people in the lowest risk age groups, offer the insurance at rock bottom prices, and undercut the ability of more traditional insurers to compete in that market.
