Alito refers 'birther' attorney Taitz's request to Supreme Court

Alito refers 'birther' attorney Taitz's request to Supreme Court
A request to U.S. Supreme Court Justice Samuel Alito by "birther" attorney Orly Taitz asking that $20,000 in sanctions against her be reversed was referred on Tuesday to the entire court.

U.S. District Court Judge Clay Land imposed the sanctions last year after he warned her and then gave her a time limit to explain why he shouldn't fine her in the September 2009 case of Capt. Connie Rhodes, who questioned the legitimacy of Barack Obama's presidency.

Taitz appealed the sanctions to the 11th Circuit Court of Appeals in Atlanta. That court upheld the sanctions in March, and Taitz sent an application for stay to U.S. Supreme Court Justice Clarence Thomas on July 8. Thomas denied it a week later.

Taitz then refiled it with Alito on Aug. 4. That request was referred on Tuesday to the entire nine-member court, the Supreme Court's website states.

Thomas denied it? That's amazing -- and interesting that Alito referred it to the entire court. She finally gets the hearing she wants. What a joke.

4. I don't think they are looking at the birther question, and the court won't hear it

but it does show how extreme the wacky right flank of the court is, which is comprised of Justice Alito all by himself.

7. It's standard when someone submits to a second justice they refer it to the full court
That way, when it's denied, the person isn't just going one by one, it's just flat denied and nothing left for her.

I expect a 9-0 decision denying to hear it.

9. No she won't. Rachael just explained it.
After Thomas rejected her request, she wrote Alito. It's pretty much standard procedure to just refer it to the SC where it will be slapped down by the entire lot and then they can ignore her forever more.

This should be interesting.

Mind you, our president's birth history/legitimacy is not the case that's going to be presented before the SCOTUS. Rather, the court will decide whether or not the sanction against her should stand.

11. Knowing Orly, she'll come armed with a bazillion complaints and try to present them all.
She's never stuck to the topic at hand. That is, if she actually goes before the court. Is that how this works or do they just look at documents and render a decision?

Think about it -- if they do tell her she has to pay up, she'll call Scalia an Obama-thug. That raises a chuckle.
