CNN poll: Majority of Dems. and Independents think Constitution conveys the right to gay marriage
Of course, these were just polled Americans, not vaunted "Constitutional scholars". :silly:

Nearly half of all Americans think the Constitution provides same-sex couples the right to marry, according to a new CNN/Opinion Research Corporation Poll.

Forty-nine percent of respondents think gay and lesbian couples have the constitutional right to get married and have their marriage recognized by law, while 51 percent say those rights do not exist.

The gap widens dramatically when age is taken into account. Nearly six in ten Americans under the age of 50 say gay rights are protected under the Constitution. Only 38 percent of Americans over the age of 50 say the same thing.

"This is one of the few instances when independents side with one party rather than falling in between the Dems and the GOP," CNN Polling Director Keating Holland said. "56 percent of Democrats and 57 percent of Independents think the Constitution conveys the right to marry to same-sex couples. Only a quarter of all Republicans agree."

2. They're sadly mistaken. Their misunderstanding reflects the sorry state of the teaching of history.
The Constitution doesn't "convey" or "provide" ANY rights.

It affirms rights.

5. Here's a link to Cornell's annotated version of the Constitution. Please indulge us,

Article I defines the Legislative branch of the federal government.

Article II defines the Presidency and the Executive branch of the federal government.

Article III defines the federal judiciary.

Article IV defines the relationship of the states to the federal government.

Articles V - VII deal with the legal status of the Constitution and the process for amending it.

The articles of the Bill of Rights limit the scope and powers of the government, and enumerate certain rights for special protection. The rights mentioned in the BoR were clearly understood to already exist at the time it was written, and Article IX deals with non-enumerated rights (Executive summary: They exist.)

In particular, the right to marry the person of one's choice.

I've read it many times, and I am not aware of any. The Constitution is silent on marriage, therefore people have the right to marry.

12. He's right though.
The Constitution limits the government from infringing on rights that we, as human beings, already have.

It seems unimportant, but it is actually an incredibly important part of the entire philosophy behind the Constitution.

To say the Constitution "grants rights" is to say that those rights can be taken away.

If the Bill of Rights was repealed, we would STILL have freedom of speech, religion, assembly, etc. The government could much more easily infringe on those rights, but we would still have them.
