Currently:

Thank you for voting!

Yes -- Prop. 8 violates the Constitution. 23% (4,985 votes)

No -- Marriage is an institution between a man and a woman. I don't care what the judge thinks about the Constitution. 67% (14,636 votes)

I'm not sure but shouldn't the voters views count for something? 9% (1,952 votes)

7. The ironic thing is that the judge was following strictly, the Constitution when the ruling was made
Prop 8 violated the Equal Protection Clause of the 14th Amendment.

Pure and simple.

It also violated Section 10 of Article I.

Prop 8 could be considered a Bill of Attainder. A Bill of Attainder is a law passed that subjects a particular entity or set of individuals to a law that doesn't apply to the rest of the people. Prop 8, by banning gays and lesbians from marrying, and not heterosexuals, applies to only a relatively small section of the population. Thus, a Bill of Attainder.

Therefore, overturned.
