Soldier whistleblower gets 25 years?
Saw the headline at Rawstory this am..went back to read it and can't find it..Is this true? Why?

1. If true, he was found guilty of violating several paragraphs of the legal code.
It is against the law to turn over classified information to those not authorized to view it. Every item he turned over is an additional count.

Like committing any other crime, it is punishable by a prison sentence.

However, I can not find it anywhere, so Rawstory may have gotten ahead of themselves.

2. Or the OP did. It's my understanding they are "considering charges."
That was something I heard a few days ago. There's not been nearly enough time in a case with this many complications for a sentence to be handed down, even in the military.

3. That is what I have heard. It is unlikely he would get 25 years...
though jail time is inevitable as is a Dishonorable discharge.

5. And while some see him as a hero
in the military system he committed a serious offense.

Oh and don't forget the give me, Conduct Unbecoming.

That said, more of this happens when you have draftees that really don't care. They help to keep the force democratic and honest.

9. He IS a hero. Screw what the military system thinks of it.
His action was conduct becoming a citizen.

10. This isn't a movie where the hero violates the law for a good cause and gets the girl...
Heroes make sacrifices, and those sacrifices often carry a heavy price. Ask Gandhi about that.

I saw that video..classified or not, it was important and disturbing..I'm appreciative to him although it was not something I wanted to see.

11. Whether they were murders hasn't been determined...
but revealing the information was a crime and he did the right in doing that. If there were no cost to these types of courage, there would be no hero's.

The principal accusation against Yamashita was that he had failed in his duty as commander of Japanese forces in the Philippines to prevent them from committing brutal atrocities. The defense acknowledged that atrocities had been committed but contended that the breakdown of communications and the Japanese chain of command in the chaotic battle of the second Philippines campaign was such that Yamashita could not have controlled his troops even if he had known of their actions, which was not certain in any case. Furthermore, many of the atrocities had been committed by Japanese naval forces outside his command.

The court found Yamashita guilty as charged and sentenced him to death. Clarke appealed the sentence to MacArthur, who upheld it. He then appealed to the Philippines Supreme Court and the United States Supreme Court, both of which declined to review the verdict. As a consequence, Yamashita was executed on 23 February 1946.


On 23 February 1946, at Los Baños, Laguna Prison Camp, 30 miles (48 km) south of Manila, Yamashita was hanged

12. No, they are more likley trying to determine just how much damage...
was done with his leak. Investigations can take a lot of time.
