HUGE Day at the Supreme Court
Everyone knows that today the Kagan hearings begin in the Senate. Well, at One First street things are going to really heat up.
4 decisions will be coming down this morning.

McDonald v. Chicago (http://scotuswiki.com/index.php?title=McDonald_v._City_of_Chicago) This of course is a big one, probably the biggest since Citizens United, and will determine whether handgun ownership is a "fundamental" right under the Bill of Rights. If the NRA pulls this one through, say goodbye DC gun laws. :( How perverse that will be that they can't get congressional representation nor decide their own gun policy.

Christian Legal Society v. Martinez (http://scotuswiki.com/index.php?title=Christian_Legal_Society_v._Martinez) Determines whether our public universities will have to subsidize Christian hate speech (although this could majorly backfire on the conservatives)

Free Enterprise Fund v. PCAOB (http://scotuswiki.com/index.php?title=Free_Enterprise_Fund_and_Beckstead_and_Watts,_LLP_v._Public_Company_Accounting_Oversight_Board). Another big case in white collar crime.

Bilski v. Kappos (http://scotuswiki.com/index.php?title=Bilski_v._Kappos): Less political (and of interest to many readers here) but read how it could have a huge effect on intellectual property.

I'm not feeling much too confident about these for our cause, Especially McDonald. I could see the conservatives carrying the day 5-4, 5-4, 5-4. But we shall see.

1. i'll be pleasantly surprised if all of these aren't 5-4.
we'll lose the gun case -- the nra has the conservative court locked up.

4. We will probably win CLS v. Martinez. Probably a Ginsburg opinion.
McDonald and FEF, we will lose.

My political views have never been determined by the wording of clauses on documents from the eighteenth century, and that applies to all of the Bill of Rights.
