Kagan fought against the scourge of pornography and other "social evil "

A review of Kagan’s writings, public comments, and legal briefs offers a series of indications that she stands in the camp of left-leaning legal academics who view pornography as a social evil that the government should be taking more action to control.

Some of Kagan’s proposals, particularly her call for more prosecutions under the largely dormant obscenity laws, are highly controversial among civil libertarians and First Amendment advocates.

Her views on this "resonate with socially conservative groups..."

5. Well, smoking is a sin too, and plenty of people want to punish others for what they do with thei
their body.

If porn, premarital sex, abortion, etc can be shown to have effects I don't like then I will join the rest of folks who gleefully use taxes and new laws to punish those who deviate from the bible...err personal beliefs.

Porn hurts others, toys in happy meals kill millions of people a year, driving cars and posting on the internet...well ignore that one, abortions - if you don't want one DON'T HAVE SEX simple as that, you made that choice (at least we should tax the hell out of it to make people think twice - the rich won't care of course).

Freedom is a pain in the ass of those wanting to try to force others to live their lives the way you think is 'right' for them.

8. Yep, mankind has spent its existence trying to make others just like this one
or that one. It's a pretty dumbfu** species for supposedly being intelligent. Of course, we define ourselves as intelligent. I wonder what other intelligence in the universe thinks, or maybe that is why we are so alone on the outpost Earth.

11. From what I know of her record, I support Kagan on a wide variety of issues - but not this one.
What is it with all this fretting & stewing over people who like to look at NEKKID bodies? It seems an odd convergence of the Fundy Right with the Dworkin Left (I don't call people who join hands with Pat Robertson in wanting to get Playboy taken off the shelves "liberals" or "progressives," since they are neither IMO).

:shrug:

I still think she will make a fine Supreme Court justice, but I don't like her apparent view of the First amendment on this issue.

I think right wing radio is certainly "low value speech"...If you can ban pornography, then how about taking right wing talk off the radio....

President Obama dropped the ball on this nomination, plenty of FAR better choices (Wood, Koh, Liu, Sunstein, Karlan) and he nominates someone like Kagan....Simply an awful choice...
