MONTGOMERY — Attorneys for a former Alabama governor convicted of bribery and other charges say a U.S. Supreme Court ruling on a white collar crime law could lead courts to throw out at least some of counts against him and a former HealthSouth CEO.
The Supreme Court on Thursday ruled that prosecutors erred in using the "honest services" law in the prosecution of former Enron CEO Jeffrey Skilling. Ex-Gov. Don Siegelman and Richard Scrushy were convicted in 2006 of bribery and other charges in a federal government corruption case.

Justice Department spokeswoman Tracy Schmaler said prosecutors could not comment on the Siegelman case. She said the department is disappointed that the court "narrowed the honest services statute," but was pleased it "upheld many of the core provisions that have been used for decades to prosecute corrupt public officials and corporate executives." The court is expected to decide on Monday whether it will hear the appeals of Siegelman and Scrushy.

Kilborn said the court could decide not to hear the appeal, but send the case back to the 11th Circuit with instructions that the case be reviewed again in light of the court's ruling in the Skilling case.
Kilborn said he believes the honest service statute redefined what bribery in political corruption cases. "Everybody knows bribery is a crime. But nobody from President Obama to small town mayors thinks if you appoint someone to office who gave you a contribution, that it's a crime," Kilborn said.
