No stockings, now no problem at Disney theme parks

ANAHEIM, Calif. (AP) -- Female workers at Disney theme parks have been granted the right to bare legs.

Disneyland spokeswoman Betsy Sanchez says that women working the Anaheim theme park and other Disney resorts no longer have to wear pantyhose when dressing in skirts.

The change was announced within the company on May 28. Sanchez says it came after a review of clothing guidelines and a comparison with dress codes at other Fortune 500 companies.

Women now are also permitted to wear sleeveless tops, as long as the shoulder straps are at least 3 inches wide, and open-toed shoes. Men can now wear casual, untucked shirts.

Sanchez says the changes apply mostly to behind-the-scenes workers in resort offices, not costumed characters.

15. This was actually litigated in New York State a couple years back.

I believe the ruling was that it was indeed discrimination to let men go shirtless in public but to prohibit women from doing so, thus, the prohibition for women was thrown out of court. I am not a lawyer so if I'm wrong and someone who knows better can correct me, that would be terrific.

2. Under law, I don't think so. If Hooters can insist on...well...hooters then Disney can...
insist on a dress code. Under law that is not discrimination.

5. Yup, don't tell me I can't wear sandals but a woman can or I have to wear a tie
but women can rock a comfy sleeveless.

I call bullshit on dress codes. Many a time I've been required to be all suited up and the women looked like they were chillin around the house, about to hit the club, or sitting there in a polo and khakis that I'm jealous off.

7. Take the same pair of legs...
one bare, one with panty hose, and I prefer the bare. Now, nylons with the line up the back is a different story :)

9. Disney always has had bizarre dress codes for their employees.
It would make sense in Anaheim and wherever it is in Florida that they are, that dropping the pantyhose rules would make sense considering THE HOT WEATHER!!!

My personal opinion is that any dress codes are discrimination unless the employer is willing to provide a uniform that they pay for if they want to control their image. However, the employee should be able to protest if the uniform is uncomfortable or interferes in their ability to do the job in any way. I actually fought something like this in my past and won.

11. It is discrimination, but it's not illegal discrimination.
Discrimination happens all the time, and most discrimination is perfectly legal--who you choose to date, marry, go on picnics with, go to work for, hang out with socially, call on the telephone--all these are examples of perfectly legal discrimination. Private employers get to discriminate too--in terms of who they hire, fire, promote, etc., so long as the basis for their action isn't a protected category (race, religion, sex, national origin, etc.).

While it is, under Title VII of the Civil Rights act of 1964, illegal for a private employer to "discriminate" on the basis of sex, actionable discrimination requires that the injured party suffer "adverse employment action" because of his or her sex. Is it adverse employment action for women to be required to wear a bra while men are not so required? I doubt it. I suspect that having different dress codes for men and women is completely acceptable and does not constitute "adverse employment action." It appears that Disney's lawyers came to the same conclusion.

As always, consult an attorney in your jurisdiction for a legal opinion upon which you intend to rely.

16. When I was in high school
girls could wear shorts and boys couldn't. I thought it was unfair. I used to complain about it. It was explained to me that it was about body hair. Boys also couldn't wear "muscle shirts" or tank tops, but girls could go sleeveless. It just seems sort of weird to me, but people have a lot of hangups I guess.

18. If i had to choose between wearing pants or wearing a dress with pantyhose on a hot day
Pants would win HANDS-FRICKING-DOWN. Panty hose are miserable, right on the skin, no room to breathe, it's AWFUL. At least with trousers you get some ventilation. As far as shoes go, sure guys should be able to wear open toes, but only if they get a nice pedicure first. Hell, let them wear high heeled fuck me pumps if they want so they can experience the nerve damage that women's shoes cause first hand.
