Man Arrested While Fishing Faces Deportation

HALL COUNTY, Ga. -- A 25-year-old Honduran national caught fishing without a license appeared in court hoping to avoid deportation. Josue Castro stood before a judge in a prison-issued jumpsuit and handcuffs Friday.

Department of National Resource officers arrested Castro May 25 when they caught him and a friend fishing in Lake Lanier. Hall County deputies eventually determined Castro was not in the country legally.

“It was difficult to see the way they treat him. Fishing is not a crime,” said Beatriz Castro, his wife, who is an American citizen.

Castro’s attorney, Arturo Corso, said his client was targeted because of the color of his skin and because he speaks Spanish. Corso maintained in court that Castro should have been given a citation and released. He asked the judge to dismiss the charge.

DNR video played in court showed an officer ordering the two men to talk or risk going to jail. The DNR said they charged Castro because he did not have valid identification and lied about fishing.

1. He's married to an American citizen, though?
I'm not following the legal angle here, did they not do the post-marriage paperwork?

10. The article linked in the OP links to an earlier report, which has this
"...An American citizen said she is worried about her husband, who came into the United States illegally...."

Perhaps this enters into the scenario - I don't know.

18. You should look at the costs to submit that paperwork.
We're talking about thousands of dollars to complete the process. And that's if you are able to navigate the complicated process without a lawyer.

Many people are simply unable to afford it.

This recent article discusses some of the latest fees.

http://articles.latimes.com/2010/jun/09/nation/la-na-immig-fees-20100610

And remember, this is a multi-step process with fees assessed at every step.

2. Fishing without a license. . . .
Fishing without a license is a crime in my state. Just like driving without a license. I don't like it. But we should change the law, not leave it on the books and pick & choose when it is enforced and when it is not. We are held together by our laws. If they are wrong, fix them. But in the meanwhile, enforce them. period. everybody

3. It's a crime to back out onto the street from your driveway;
In most states. Of course you do not do such a thing because it is against the law. You come to a complete stop at all stop signs and right turn on reds. Of course you do because you want all broken laws enforced. period. everybody. How about those times you cheated the IRS. Just a little!

12. And if you don't
come to a complete stop at a stop sign and you get caught, you have no complaint if it is also discovered that:

1. you are driving without a license
2. you are driving without insurance
3. you are driving a stolen vehicle
4. you are driving while impaired
5. you have drugs in your car
6. you have stolen property in your car
7. the car you are driving is stolen
8. you have outstanding warrants for your arrest
9. you are illegally carrying a weapon
10. you are in the country illegally

If any of these above listed are true, you had best be meticulous in obeying the traffic laws.

4. we are held together by our common humanity
Power is held together by law, and the powerful in this country are corrupted and predatory and a threat to all of us.

Everybody? Really? Are you f-ing kidding? Since when are the laws being enforced against the wealthy and powerful?

14. Fishing without a license is, and should remain, a crime.
Fishing licenses are essential parts of fisheries management, and the fees generated by those licenses are vital to maintaining our riverine ecosystems in the U.S. Even more importantly, virtually all states regulate the type and size of the fish you can take, the equipment you can use, and the times and dates you can use them in an attempt to protect endangered species and ecosystems. The threat of a revocation of your fishing license, and citations or prosecutions that come along with continued fishing after a revocation, is usually enough to keep most people from violating those regulations.

I fly fish regularly. I probably get stopped by DFG or local patrols and have my license checked once a month or so. I consider that to be a good thing. If you can't follow the law, you have no business being out on the water.

16. Fishing violations are actually violations of regulation and not Law.
While Regulation carries the weight of Law it is not Law. Fishing without a license is not an offense warranting arrest..
