6. Just writing an opinion that may be unpopular or even wrong is not criminal.
Even if what he said was true, the commander-in-chief should have the wisdom and show restraint to not do what Yoo says he can do.

Just because you can doesn't mean you should.

5. Is that much different than Dresden or Hiroshima?
I think Yoo's point is correct from a legal basis (that is just a gut reaction, am open to opposing argument). Of course, one thing that makes me really mad is that we don't declare way any more, that blurs the civilian vs. commander in chief duties of the President.

8. Actually no it's not
Both FDR and Truman did just that. It might be argued that carpet bombing in 'Nam and Clinton's air raids on Serbia would constitute exterminating civilians. What about drone missiles taking out wedding parties?

10. Oh I think you could draw a distinction between rounding up
and interring civilian populations and bombing in time of war. After all FDR ordered the round up and internment of American citizens after Pearl Harbor.
