Newark software company accused of H-1B labor violations

A Newark software company was accused today of violating immigration laws by withholding $1.5 million in back wages from its 163 workers.

Peri Software Solutions and its president and owner, Sarib Perisamya, were cited for alleged violations of the Immigration and Nationality Act, according to the U.S. Department of Labor.

The company failed to pay prevailing wages to computer analysts under the H-1B program, which allows companies to employ foreign computer programmers, engineers, physicians and teachers as long as they are paid competitively.

3. Fines not high enough.
The penalties should be sufficient to discourage the crime.

The equivalent would be if the punishment for murder was 40 hours of community service.

The punishment should be something like.

Fine to federal govt of 10,000% of any gains the company got by the fraud. Company profitted $1 million then they are fined $100 million.

Company prohibited from using H-1B program for 10 years, second offense would be 25 years.

Company required to contribute an amount equal to 100% of illegal gains coto state unemployment fund for 5 years.

$1.5 millon? MEH. Most companies use this logic:
If the amount we benefit via the fraud x likelihood we get caught > $1.5 million it is actually cheaper to commit the fraud.

The punishments have to be so utterly punative nobody would consider it.
