My 19 year old got a ticket for pot in CA. and they suspended his license for 1 year?!

My 19 year old got a ticket for pot in CA. and they suspended his license for 1 year?!
Is that some new kind of law or something? He got hit with a minor in possession. It was REALLY a small amount. I thought they went real easy of weed possession these days.

If so, its treated like a DUI. Did he have to appear in court?

I got one of those "tickets". In all places, Disneyland.(Long story). The Anaheim PD took the roach from my ashtray and wrote me a ticket and a court appearance. $185.00 fine and it comes off my record if no arrests for weed for 1 year.
I never heard of them yanking a license for that though.

Where in CA?

7. No, he was not driving.
He was outside of a car but was not the driver. They were "star gazing".

2. Where and what was the ticket for?
I have a friend here in SF who was busted for selling (small time stuff) and he spent a few hours in jail and got probation. :shrug:

That suspended license must be for something else, not just pot possession. I think there is more to this story.

10. He received a ticket for pot possession that the cops found
upon asking to search their car. They gave them permission. He mentioned something about minor in possession. He actually thought he didn't have to appear if he didn't get something in the mail. However, he and 2 of his dorm-mates all received notice of bench warrants in the mail today so they all went down to the courthouse and that's what the judge did to all of them. That an a $340 fine.

39. It's possession of a minor amount I believe.
Something like 48 grams or less IIRC.

It depends on the county. Some are very lenient like Humboldt where the Sheriff has declared he isn't interested in marijuana crimes of the city of Snata Cruz which voted to make possession the least of the police departments concerns to my county of San Diego which raided and shut down virtually all providers.

15. He wasn't driving. The kids were sitting outside of the car stoned I guess.
The cops came up, a couple of them got smart and hence the tickets.

State law calls for a small fine for possession under an ounce.

14. Yes the judge told him he could apply for a restricted license but
he lives on campus and doesn't work. However that no working crap is coming to a screaming halt. I am not gonna pay for his pot smoking and the problems that it is causing him.

17. That's kind of harsh.
My daughter got busted with a little pot in her car at school, and since she was over 18 they charged her with felony possession. (Even though marijuana is basically legal up here, you still can't have it around a school). Everybody was cool about it though. She got suspended for a couple of weeks, had to take a drug class and do some community service, but they expunged her record. Nothing at all happened to her license.

I've been caught with pot many times in Austin. All they did was take it away from me, dump it in the wind and laugh maniacally. Some just stuffed it in their belts and split with it...<g>

I am sorry this happened to your son and that seems awfully harsh.

19. Sounds like, possibly, he was charged with providing it to a minor
If a minor is present, that's usually what happens, and I presume the punishment is harsher than for just simple possession.

Hope your son can get this worked out and behind him.

25. back in my days, in the 70's, it was like a speeding ticket. to suspend
license is to disrupt work, and ability to take care of oneself. find it odd that they feel the punishment needs to be directed to unrelated event of driving a car.

no smoking and driving?

just a law ... find pot, no driving?

26. Here's the relevent CA law...
Driving suspension for minors: Any minor (age under 21) convicted of a marijuana, alcohol, or other drug offense faces a 12-month drivers license suspension, regardless of whether the offense was driving-related. The court may allow restricted license privileges if the minor demonstrates a "critical need to drive." Vehicle Code 13202.5 . (Note: This penalty can be avoided by entering a diversion program).

43. Hey that is good news. I spoke to him yesterday.
He called the public defenders office and wants to fill out paperwork for a change of plea. So, I need to tell him about a diversion program to keep his license.

Kids today need to stay straight!!! I figure by the age of 21 they should of have figured out what they are going to be doing for the rest of their time here. So the law here in CA is a good one. The law is made to help the kids get a decent start in the game of life. No flaming please!!! I was made to go to church every Sunday till I was 16, then it was my choice to go or not. I am now 53 years old. Been to Nam, and had problem being a bit on the wild side for a few years after. And to this day I think church kept me from going down a "much" more problem ridden life. Same for dope, let the kid be a kid till 21, then let them do what they want. I bet 50% would of chose not to smoke pot, or any dope. I could say more about the parents who let their kids do dope while in their teens, but won't.

But ya have to admit that getting a positive taste of a little good character during growing up usually makes a better person than smoking pot while trying to learn the ways of life.
1. Which kid do you think has more of a chance of ending up in the prison system?? One that does dope, or the one that does no dope??
2. Which kid has a better chance of having a high paying career? The non dope user, or the dope user??

I know, I know, sometimes a dope user gets lucky and gets a good job, but I am talking stats.

But it can not hurt!! I know a bunch of folks who might of took a different path in life if they had a taste of Religion when younger. I do not go to church, have not in 35 years, but it might of been the thing that kept me out of the prison system.
