1. Because, as one DU poster pointed out some time ago,
...the U.S. Flag Code is wholly unenforceable. It would be like citing someone for violating the food pyramid. :)

3. ROFL violating the food pyramid
We'd have incarcerate everyone in this country. The McDonald's employees alone would fill every prison we have.

4. Actually, unlike the food pyramid, the Flag Code IS codified.
It's true that past practice has been non-enforcement, but there IS the mechanism to change that.

10. I believe the code lacks enforcement language.
I of course could be remembering the discussion completely wrong. I also don't remember who made the food pyramid snark, but I've been ripping it off ever since. :hi:

11. The Code has enforcement language, the courts just keep finding it unconstitutional.
...and the food pyramid reference IS snarky genius :)

And, by all means, enforce the flag code as to my avatar. :eyes:

6. The flag code only pertains to United States flags.
That item is a novelty flag and, therefore, is not a United States flag.

16. Enforced in past if one was a high-profile anti-war activist
with only one shirt to give for your country. Back in the day, wearing a 'novelty' representation of the flag was possibly punishable by giving activist serum hepatitis.

...
The Chairman of the Joint Chiefs of Staff, Air Force General Richard Myers, joined the parade, which rumbled toward the national mall for a wreath-laying ceremony at the Vietnam War Memorial. He was wearing a shirt emblazoned with the American flag.

Ah, if only Abbie Hoffman could have witnessed that.

In October 1968, he was arrested in Washington for wearing a shirt that resembled the design of an American flag. Authorities at the maximum security penitentiary did their worst to harass and humiliate him. They gave him a preventive de-lousing. They took a blood sample against his will, without affording him the sterile courtesy of a disposable syringe.

Two months later, Abbie was hospitalized in New York City for serum hepatitis. The recuperative process didn’t prevent him from helping doctors to organize themselves against some of the oppressive tactics of the medical profession.

7. If it's of any comfort,
Edited on Wed Oct-14-09 08:08 AM by sailor65
that's not a U.S. flag. If, as it appears, the item was manufactured with the face on it, then it is not a U.S. flag and is nothing more than a decorative pennant.

Now if a real flag were actually modified, then it would be a problem. Unfortunately, as too many DUers are proud to announce, the Flag Code has been pitifully enforced, if ever, and the scumbags who dishonor the flag don't typically pay a legal price.
But they do make good fertilizer

8. Seems to me that it's not a U.S. flag. How do you quantify levels of sameness?
What if he put 15 stripes instead of 13, but left the stars?

What if he left it at 13 stripes and the Obama face, but insead of white stripes used tan?

I could go on and on.

12. I just posted this hurry before it disappears.
What a bunch of Neanderthals, but you already knew that. First, flag code is UNENFORCABLE, that's why you slugs can get away with WEARING the flag and defacing it with your stink. Secondly, the only thing that's going to come out of 2010 is a greater DEMOCRATIC majority since you clowns have NO money to unseat anyone, but we will get your cockroaches out of the House and Senate.

I mean it's not something I would buy but what's illegal about it. I mean this flag below is allowed or I haven't heard of anyone arrested over it.

14. A little thing called free speech.
Part of the constitution, you know?

Personally, the flag has such a special meaning to some individuals with whom I have no particular beef that I am not deliberately disrespectful to their feelings by doing things they would consider to be defacing the flag - but if wanted to, it would be within my constitutional rights to do so.
