...because so far as I know, Brandenburg v. Ohio is still good law on speech.
...the constitutional guarantees of free speech and free press do not permit a State to forbid or proscribe advocacy of the use of force or of law violation except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.
The three-part test in Brandenburg -- intent, imminence, and likelihood -- is hard to pass, and for a good reason.

and sedition is NOT the same thing as dissent.

p.s., funny you should mention 'brandenburg,' as that's my 'stranged husband's last name, and just having a disagreement with him!!! And of course he's from ohio!

10. Watch Glen Beck and the managerie of talking heads on Fox news if you can stand it.
They flirt with sedition and almost make it. When Beck speaks of "cells" and Hannity takes a poll regarding revolution and succession it is getting close to sedition. Easy to forget just a few years ago people were being arrested for wearing anti Bush T-shirts.
