Please! ALL! prepare for this action for Troy Davis on Tuesday!!
A letter from NYC FreeTroy folks:

Dear friends,

As all of us know by now, on June 25, the Supreme Court will conference to decide whether to allow a court to hear Troy Davis’s case. If the court rules against him, Chatham County, Georgia District Attorney Larry Chisolm will have a decision to make.

Either he can reopen Troy’s case and let his evidence of innocence be heard, or he can perpetuate an injustice and seek a fifth execution date for Troy.


On Tuesday, June 23, Martina, Troy’s sister, and The Campaign to End the Death Penalty are calling on people around the country and around the world to call Chisolm to seek justice, and remind him that we are watching to see what he will do.


I know we have already faxed him, e-mailed him and called him in the past, but we need to get that letter ready again and make sure we all come together next Tuesday and bombard him, every single one of us, united, against this colossal miscarriage of American Injustice.


Let’s fax, call and email Chatham County D.A. Larry Chisolm again on June 23. Let him know that we want him to re-open Troy Davis’s case and that we expect him NOT to seek yet another execution date.

Despite the fact that seven out of the nine witnesses in Troy’s case have recanted their testimony, and six people have signed affidavits implicating another man in the murder of Mark MacPhail, no court has agreed to hear from the witnesses to evaluate their testimony. Chisolm can re-open the case, and change all that. He ran last November on a platform of accountability and fairness. Let’s remind him that accountability and fairness start with his actions in Troy’s case.

INNOCENCE MATTERS NO MATTER WHEN IT COMES OUT, IT DOES NOT HAVE A TIME LIMIT!


As most of you know, in a desperate attempt to silence Troy, the Georgia Department of Corrections has always prohibited all television access to him. Interview requests from 60 Minutes, Dateline NBC and the Associated Press have been denied, and the prison has threatened to revoke Troy’s phone privileges should any family member allow media to speak to him. These drastic infringements on Troy’s First Amendment rights are a measure of the state’s fear that exposure could reveal the truth about racism and injustice in Chatham County and in the state of Georgia.

So, this is what we are dealing with. All Troy has is our voices, so please, please, let’s make sure Chisolm is going to hear thousands of them next Tuesday.

I will (re-post) on Monday to make sure you remember to have your letter ready to be faxed, Chisolm’s phone number in your purse or wallet and his email before you go to work on Tuesday.

23. Savannah, GA Rally and Actions for Troy Davis, Tomorrow!! (Sat.)
The “I am Troy” campaign will kick off Saturday at 10:00 a.m. with a rally at 38th Street Park at 38th St and Martin Luther King, Jr. Blvd. Volunteers will then disperse through Savannah neighborhoods to gather signatures.

There will also be a community mass meeting at 6:00 p.m. at Bolton Street Baptist Church.

Events include a rally on Saturday morning, a community meeting on Sunday evening, and of course canvassing Savannah all weekend (details in the link). Hope you can make it out to show your support for Troy Davis!

As you know, the Supreme Court is expected to decide if they will hear Troy's case on June 25th, so we need to maintain the high visibility for this case. If the Supreme Court decides not to hear the case, all of our attention will shift to Larry Chisolm, Chatham County District Attorney, to persuade him to intervene in the case. One important component to that is media attention, and lately Troy's case has generated tons of it! Along with recent op-eds in the NY Times and LA Times, Newsweek just published this fantastic article yesterday

Week of Witness for Troy Davis

Friends,

The US Supreme Court is expected to decide whether or not to hear Troy's case on June 25, making their decision public in the days following. In preparation for that, Amnesty Int'l and NAACP have called for a Week of Witness for Troy Davis to be held next week, from Friday, June 19 to Friday, June 26. The intent is to keep the public spotlight shining on Troy's case during this critical time.

If the conviction of Troy Anthony Davis and his subsequent death sentencing resulted from "lies," then a "cop killer" has remained at large for 18 years, the top executive of the national NAACP said Friday. That is what occurred, asserted Benjamin Jealous, president and chief executive officer of the National Association for the Advancement of Colored People, and it demands that Chatham County District Attorney Larry Chisolm reopen the case.

"The interest of the state is in the truth," he told the Savannah Morning News in a Friday interview. Jealous is in Savannah as part of "I AM TROY," a grassroots campaign and petition drive to spare Davis from execution at the Georgia Diagnostic and Classification Prison near Jackson. The campaign is part of a nationwide initiative.

Davis, 38, was convicted and sentenced to die in 1991 for the murder of off-duty Savannah police officer Mark Allen MacPhail. A litany of appeals has failed to sway various courts, although Davis has evaded execution three times. On Thursday, the U.S. Supreme Court is expected to consider the latest challenge by attorneys for Davis. Jealous, along with state and Savannah Branch NAACP groups, wants Chisolm to reopen the case and find the assailant who is truly guilty. They say seven of the nine state witnesses at the original trial have recanted their testimony. Execution of Davis will mean a possibly innocent man will die, they further argue.

Included in the NAACP effort this weekend are:

-- 10 a.m. to noon today:A rally is scheduled at the 38th Street Park, followed by a local petition canvassing in surrounding neighborhoods.

-- 6 p.m. Sunday: A mass meeting is planned at Bolton Street Baptist Church, 821 Martin Luther King Jr. Blvd.

The case rested on the shoulders of nine eyewitnesses—including the man who named Davis as the shooter but who others say is the real culprit. Seven of those witnesses have recanted. Most say they lied under pressure from police or prosecutors. A succession of courts has rejected their affidavits. Davis now has a long-shot petition pending before the Supreme Court requesting a hearing so those witnesses—who have never explained their reversals in court—can be heard.

So what if Davis is innocent? He blew his chance to prove that (notwithstanding that his previous attorneys were financially crippled), so it's not the A.G.'s concern. But it is the concern of his supporters. Ben Jealous, head of the NAACP, which filed a supporting brief, calls it the "most compelling case of innocence" he has seen. So why have courts been so reluctant to intervene? In part, because recantations are inherently suspect since they generally are offered by codefendants or family members. Then there is the Antiterrorism and Effective Death Penalty Act of 1996, which aspired to deliver convicted murderers more quickly to the gallows by foreclosing repeated habeas proceedings. Barr believes appellate courts are misinterpreting the law. It was never meant, he says, to prevent an appeal "where there is overwhelming evidence of innocence that has not been presented—What's the burden on the state, for heaven's sake, to take a day to have an evidentiary hearing?"

So prosecutors generally prefer to let verdicts stand. But what DNA testing has made clear is that juries often make -mistakes—especially when relying on eyewitness testimony. Since 1989, more than 230 inmates have been released on the basis of such tests. Nearly 80 percent were convicted largely on eyewitness testimony, says Brandon Garrett, a University of Virginia law professor. The police can guard against planting false memories and thereby inducing false identifications by making sure witnesses are not cued to choose particular suspects. That was not done in Davis's case. And it is still not the norm. So you end up with this toxic combination: tainted identifications, inadequate legal resources and a court system reluctant to revisit jury decisions come together to create this truly Orwellian situation in which a possibly innocent man is asked to die because that is more efficient than reexamining the facts.

What happens if the Hail Mary pass to the Supreme Court fails? Larry Chisholm, the new district attorney in Chatham County, will certainly feel pressure to get involved. But the issues go beyond Davis. If courts are truly misreading the law, perhaps the law needs to be changed. The more profound question is this: must we accept that some plausibly innocent people will die as the cost of streamlining the process of justice? I think it is far from certain that Troy Davis did this. I can't say I am convinced he didn't do it either.

The NAACP and supporters of Troy Anthony Davis, came out to promote their Grass Roots Campaign on Saturday at the 38th Street Park.

Music, games, and even food were on hand as supporters worked to get people to sign a petition, urging Savannah District Attorney Larry Chisolm to re-open Davis's case.

To DeJuan Correira, his “Uncle Troy” embodies all of these attributes. A mentor to his nephew, Troy Anthony Davis played a prominent role in DeJuan’s development into a superior student while simultaneously providing support to DeJuan’s mother, Martina, Troy’s sister who was diagnosed with cancer in 2001. Davis’ accomplishments as a father figure and family man are astounding given his circumstances; since 1991, Davis has been on death row, wrongly convicted of the murder of Savannah police officer Mark MacPhail.

But the Troy Davis case is the most compelling case of wrongful conviction in decades. No physical evidence links Davis to the crime; no murder weapons were found and seven out of nine eyewitnesses recanted or contradicted their original statements. The facts of his innocence are so overwhelming that it has inspired conservative former Congressman Bob Barr and former FBI head William Sessions to speak out. The chorus calling for a new trial includes former President Jimmy Carter and Pope Benedict XVI. Despite irrefutable evidence of his innocence, Chatham County is one of 159 counties in the state of Georgia. The county currently has approximately 250,000 residents, less than 3 percent of Georgia’s state population. Yet this tiny county has produced one-third of Georgia’s exonerations and 40 percent of its death row exonerations, statistics that reveal a questionable history of negligent legal practices. The Troy Davis case is the latest in a series of disturbing instances of Chatham County’s disregard for justice and a proclivity to prosecute and potentially execute people innocent of the crimes of which they've been convicted. The new Chatham County District Attorney, Larry Chisolm, who is black, could reopen the case, but so far he has refused to do so.
In a desperate attempt to silence Davis, the Georgia Department of Corrections has prohibited all television access to him. Interview requests from 60 Minutes, Dateline NBC and the Associated Press have been denied, and the prison has threatened to revoke Davis’ phone privileges should any family member allow media to speak to him. These drastic infringements on Davis’ First Amendment rights are a measure of the state’s fear that exposure could reveal the truth about racism and injustice in Chatham County and in the state of Georgia.

While many in his position would be resentful about the unfair circumstances and an unjust system that put them behind bars, Davis exudes benevolence, responsibility and leadership. The effect Davis has had on his nephew is evident—DeJuan achieved top honors in the state’s Social Science Fair for his project entitled “Time for Change: How Does the Troy Anthony Davis Case Affect Georgia?" From the confines of the Georgia Diagnostic and Classification State Prison, Davis has mentored and provided an example to young DeJuan by being positive, unwavering and unbroken.

This is just too sad. I just hope my two-cents helps.
Thank you for bringing Troy Davis to my attention.
I was kicked in the stomach this week when the Supreme Court ruled that William Osborne, Alaska, had no constitutional right to DNA testing after being found guilty of rape. I agree with you that there is no time limits on innocence.
