Bush Lawyer Ordered to Testify

A federal judge has ruled that John Yoo, a former Bush administration lawyer who wrote crucial memorandums justifying harsh interrogation techniques, will have to answer in court to accusations that his work led to a prisoner’s being tortured and deprived of his constitutional rights. The government had asked Judge Jeffrey S. White of Federal District Court in San Francisco to dismiss the case filed by Jose Padilla, an American citizen who spent more than three years in a military brig as an enemy combatant. Judge White denied most elements of Mr. Yoo’s motion and quoted a passage from the Federalist Papers that in times of war, nations, to be more safe, “at length become willing to run the risk of being less free.”



While the administration pulled out all stops to protect Yoo, the judge refused their arguments. The question is will Obama/Holder take this to the appellate level? Emart money is betting that the Whitehouse will indeed appeal, because the Appellate Courts are well stacked with Cheney/Bushie and Clinton appointees who are very sympathetic to the Executive Branch usurpation of powers.

The other possibility is that Yoo will be made a sacrificial goat, and hung out to dry while being blamed for all misdeeds of the Bush administration, the public will be assuaged by the rolling asian head down the guillotine ramp...this ending the drum-beating for the heads of Cheney, Rumsfeld, Feith, Bush et al.

We'll see. But my take from the actions the past 5 months by the Obama administration indicates that the worst the criminals will experience is the loss of Yoo and maybe not even that token will be tossed to 'Lady Liberty'.

1. Would like to see him in protective custody
lest he get depressed. I put nothing past cheney and his henchmen.
