Please DU this poll on Sotomayor! The haters are out in force here in New Haven
because of the white firefighters case. It won't be up forever. They are announcing the results of the poll on WTNH tonight at 6!

The firefighters case involved the New Haven FD. It's a simmering controversy here that everybody knows about. I'm afraid that a lot of good liberals here are being complacent...

9. It is relevant. Anything a judge has ruled on has to be relevant.
Here in New Haven, some whites are outraged that the white firefighters taking the test for promotion got screwed when the test results were thrown out by the Mayor, John DeStefano because no African American firefighter taking the test finished in the top positions. The fault, IMO, lies with DeStefano. He's an arrogant SOB who should have done due diligence in getting a better test that more accurately gauges ability and qualifications. This test was never used before. There ARE tests out there that are fair to ALL candidates.

Just this past week there was a "Sound off" column where a question is asked and people just phone in using their first names and their towns only. The question had lurking racial issues which the RWingers just freeped the hell out of. Serves me right for being too complacent to call in my comment. I won't make that mistake again.

16. the case is relevant
as is all that Sonia Sotomayor has ruled on... the problem is that unless we research on our own, we are spoon fed what a group/the media/?/ wants us to see and/or hear... my understanding is that there is much more to this situation than what we have been fed.

19. She was part of a 3 judge panel that basically affirmed the law.
So we don't have a written "decision" by her laying out her reasons for voting the way she did. The White House is working hard to frame this as a case of a judge NOT "legislating from the bench." She merely affirmed the law as it was established at that point.

The fault here lies with the mayor of New Haven. He could easily have found another test that other FD's across the country have used and found fair to whites and blacks. This test was an unknown country. The mayor should NEVER have gambled on it. It is an example of his incompetence.

At any rate it is now before the Supreme Court so it is out of Sotomayor's hands and we don't know how the Court will decide...

And yes, I agree. If this test wasn't iron-clad to begin with, DeStephano shouldn't have allowed it to be used. Trying to put that genie back in the can after you get the results and are afraid of the problems resulting from them is WAY too late.

But that's what I mean about a mess. The two sides both have good arguments - or equally shaky arguments, lol. There will be no answer that will satisfy. There is no possible answer to satisfy here.

A mess. A real mess.

21. Thank you. I have been trying to say this, to no avail to some at DU.
It has taken some time but I have finally been convinced that John DeStefano is not to be trusted with the office of mayor and I will not vote for him again.

His whole behavior in the Ricci case has, to me, been an example of incompetence. He should have found a better constructed test and he did not. You know, when we vote in a mayor we vote in his ability to form a staff who can govern the city properly. He obviously did not and his incompetence went beyond just this city. His decisions that led to the debacle we are now facing in the SCOTUS is ample evidence of that. His incompetence could imperil affirmative action on a national levil, a breathtaking realization in my part at least!
