Has the Defense "Our Tactics Worked, so not a Crime" ever been allowed?
I was under the impression that it doesn't matter what the results are from a "war crime". The Crime itself is what matters according to established Law. There is no doubt that Torture usually gets people to admit to almost anything, whether true or not. In fact I was under the assumption that if a person used the defense that Torture was good because it accomplished their desired goal that it was even worse for the case. It has to be the very worst Defense possible, yet that is what the Republicans are doing, and in fact insisting that our country must keep Torturing people or we won't be safe ever again..IMO if America allows this, it deserves whatever may come of it....

1. No, but Cheny is pushing it because jury nullification is his only hope
when his prosecution is undertaken.

If he can convince Amerika that torture MUST be allowed because it protected hundreds of thousands he has a chance on the jury acting to invalidate the appliation of the law in his special case.

Torture is depraved. Those who advocate torture are depraved.

2. From a logical stand-point, no the argument can't be won with that premise.
It's arguing a negative, in other words, you can't prove something is true based on the absence of evidence. If we tortured prisoners and nothing "bad" happened to this country during that period, it doesn't prove the torture worked. The two situations are mutually exclusive and not related.

3. The "results" do not matter - the US Establishment is simply trying to get mileage via misdirection
Pretty scary, actually, considering that even if they can coax the public here to suck it up and agree (as usual), the rest of the world views the situation accurately, our govt as PROTECTING AND ENABLING WAR CRIMES, and ALL of us (since in a rep democracy the govt's actions are carried out in ALL of our names) as being cheerleading accomplices whose tax dollars contribute to our empire's phony "war$."
