During the trial, Chastity Pasley and Kristen Price (the pair's then-girlfriends) testified under oath that Henderson and McKinney both plotted beforehand to rob a gay man. McKinney and Henderson then went to the Fireside Lounge and selected Shepard as their target. McKinney alleged that Shepard asked them for a ride home. After befriending him, they took him to a remote area of Laramie where they robbed him, beat him severely (media reports often contained the graphic account of the pistol whipping and his smashed skull), and tied him to a fence with a rope from McKinney's truck. Shepard begged for his life. Both girlfriends also testified that neither McKinney nor Henderson was under the influence of drugs at the time. The beating was so severe that the only areas on Shepard's face that were not covered in blood were those where his tears had washed the blood stains away.

And everyone should know who they are and where they stood. Seems kinda like they're STILL trying to beat, torture, humiliate, and kill Matthew Shepard. I don't understand these people. Perhaps they feel that because he's gay, he still hasn't suffered enough?

I was suprised to find that out -- evidently after the Civil War a lot of slaves
moved into Oklahoma and Indiana --

The saying about Pennsylvania . . .
"Philadelphia in the East, Pittsburgh in the West and Alabama in the middle."

I don't know the details on MN --

but, remember that Segregation, Inc. was strongly in place in Washington, DC
even into the 1960's -- Adam Clayton Powell, if I recall this correctly, had to
actually break the code -- I guess it was a "Gentlemen's Agreement" still --
in the Congressional dining room where he certainly wasn't welcomed.

I trust others here have better information on all of this --

but that's how these states come to be identified as the "South" -- !!!

I live very close to the Oklahoma border now, so much so that I do much of my shopping in Oklahoma and my local news comes out of Tulsa. Small sample size, I know, but Kansans tend to hide their ignorance; Oklahomans celebrate it.

Btw, I love living in the Flint Hills. I know my neighbors, they all wave hello when I'm getting my mail or mowing my lawn; if they see me taking something heavy out of my car, they run over to bring it in the house for me, and people stop by to introduce themselves. No one has attacked me for my Obama bumper sticker and they don't care. The only thing I miss from JoCo is Whole Foods :)

They may be Republicans (and 80% are) but they don't talk about it at all, and they don't treat me badly for being an obvious liberal Democrat - I have two stickers on my car, one is Obama, the other is a "sushi-eating, latte-sipping, Volvo-driving LIBERAL" on my Volvo. I had a third, which said "Fine. I evolved, you didn't" but I took it off because it's one thing to have political differences but I don't want to offend religious sensibilities down here - and yeah, there are lots of churches for a town of a thousand.

my car here in S.E. Ohio my car would be vandalized. Hard to find a progressive thinker around here, aside from my wife, mother, brother and son. I'm going to put an ad in the paper: Liberals needed for intelligent conversation. I joke. There are many progressives in nearby Athens Ohio, a kind of college town enclave of liberalism in the midst of superdutystupidity.

86. I was raised in Oklahoma, and while I know not all Oklahomans are rednecks,
I agree with you that there are some serious rednecks in the state. Hell, we had to have our junior/senior proms in a neighboring city because our little town had a "no dancing" ordinance.

99. I grew up in a town like that.
We had been living in Chicago and then headed out to a tiny little town in the West. I found out shortly thereafter that the down had an ordinance against not only dancing, but rock music as well. When prom time came around, I decided I wanted to organize my class mates to get rid of the town's outdated laws regarding rock music and dancing and I ended up going toe to toe with the town's hard-headed, fundamentalist minister in order to do so.

Oh wait, never mind. That was Footloose.

not far from where I grew up. At the time, two factions controlled everything that went on in our little town: the Church of Christ and the Baptist Church. There was a Pentecostal Holiness church in town, too, but the Baptists and Church of Christ folks considered Pentecostals extreme; ironic, I know.

When I first saw the film, it seemed so ridiculous to me. I couldn't believe that in modern times, there were towns that really had restrictions on things like that. Goes to show you, I guess.

Where I grew up dancing was not allowed, nor could we see movies in a theatre...not even a Billy Grahmn movie. It was what happened after the dance that the adults feared. Of course they would never tell us what could possibly happen afterwards. Yet, come Sunday the preacher man would be up there talking about how King David was dancing in the street when the Arc of the Covenant was brought back and how his wife was looking out from a window and laughed at him (ha, you got two left feet)so God got mad and cursed her with a barren womb.

might as well be part of the south as far as how the cultures are in large portions of those states. Trust me, you do see a lot of that mentality in at least three of those four states you listed.

You have to step outside the safety of a large city to see what a state is REALLY like. They don't call the vast majority of middle America "the fly over states" for nothing.

73. Chris Carney is Northcentral Pennsylvania - which is pretty much like the south
Unfortunately he's in a district that if anyone else runs a democrat they would probably lose. That seat was owned by the republicans for decades and the only reason Carney won was that the incumbent Don Sherwood was caught beating his mistress. Because Carney is so fricking moderate to conservative, he'll easily win his district again by voting the way he did today on issues like this.

It's really a no-win situation - we find a primary opponent that could take out Carney you'll put a republican in there instead.

Central PA is actually, literally, Appalachia

I've been to bars in Carney's district, looking for a bite to eat on my way home from state college, and they are Deliverance-scary ("uh, guys, maybe we'd better drive back to the McDonald's in Williamsport....")

Once you leave Reading, and until you hit Pittsburgh, you're driving through small towns where the car radio can pick up only 1) Christian radio 2) country music 3)head-banger metal.

I understand that folks here are pissed at Chris Carney but the scary thought is this - you get rid of Chris Carney you're going to have alot worse then him because it will be a republican.

I spent a little time in Harrisburg when I was dating a guy from there that I met in Avalon.

And you're right - Harrisburg and Lancaster are fine, but a few miles outside and you're in trouble.

Also right about Carney - the alternative is some Club for Growth wannabe or Christian Dominionist.

and liberal areas in the south. It is interesting to note the geographic concentration of the nay votes. It is not a random distribution throughout our nation.

it's quite obvious that they are not talking about everyone in the South. They are talking about the Democrats who voted against the Matthew Shepherd Act; he ones listed in the OP.

I'm from the south (and so is the person you were replying to) and I would have voted FOR the Matthew Shepherd Act had I been in a position to do so.

Democrats and Republicans pretty much think the same in this state as far as our elected representatives.

It sickens me too.

59. wow, Hissyspit, sorry. But you are a great person then to write or call his office and reference
your donation & date of it, and how all this bill did was help make the small minority of bigots know that there was no getting out of attacking your fellow citizens who are different than you, and therefore it'd help encourage a reminder that they will be punished for doing so. It's not special rights, it guarantees equal rights that too often are not granted because of bigotry and Shuler apparently supports violence against GLBT people. He now has become as big as a failure as he was to the Redskins. Way overpaid in both aspects of his life.

And PS - thanks for your posting of videos always, I thank you from time to time, but it's important you do what you do to help centralize info we'd all want to see, and it's appreciated.

The Matthew Shepard Act would strengthen existing federal hate crime laws in three ways:

1) Expand the law to authorize the Department of Justice to investigate and prosecute certain bias-motivated crimes based on the victim's actual or perceived sexual orientation, gender, gender identity, or disability. Current law only includes race, color, religion or national origin.

2) Eliminate a serious limitation on federal involvment under existing law which requires that a victim of a bias-motivated crime was attacked because he/she was engaged in a specified federally-protected activity such as voting, serving on a jury or attending school.

3) Add "gender" and "gender identity" to the Hate Crimes Statistics Act

Until he was targeted for a takedown because of his concern for the human rights of Palestinians, Earl Hilliard represented Alabama's House District 7. Rep. Hilliard was LGBT-friendly: he voted in favor of extending benefits to same-sex couples, and also voted against barring gays and lesbians from adopting children in the District of Columbia.

Earl Hilliard was a member of the Congressional Progressive Caucus. He was one of the best. I still can't believe we let that happen to him.


Anyway, that's story behind one of the votes cast against the Matthew Shepard Act.

Guess I'll give you all a punching bag for this thread (i.e. ME). I'm not a believer in mandatory additional punishment based on 'hate' as a motive. A murder results in a dead human being, regardless of the motivation behind the murderer's action. Same goes for any crime against the person. A raped woman is just as raped whether it was done because she 'looked good' to the perp, or because the perp wanted to force a man on her because she's a lesbian. There is no reason why the rapist who rapes a straight woman should be punished less than the rapist who rapes a lesbian. There is no reason a murderer who kills a white man should be punished less than a murderer who kills a black man. There is no reason a mugger who beats and robs an old woman for the change in her purse should be punished less than a mugger who beats and robs a gay man because he doesn't like gays.


Judicial discretion and sentence ranges, as well as the parole system, can accommodate variances in prison sentences based on viciousness of the crime and lack of remorse. Hate crimes laws only throw a wrench in the works and force uneven and unfair sentencing based on the thought behind the crime, rather than focus on the crime itself. For this reason, I'm opposed to hate crime legislation, including federal and state hate crime laws already on the books. To me, its no different than the mandatory federal sentencing guidelines that punish more severely for crack than for powder cocaine.

About 20 years ago I lived for two years in rural Japan, and was the only person from the western hemisphere, let alone of another race, for about 50 miles in any direction. I had people following me around in grocery stores to see what I'd buy, and I was refused entry to businesses regularly because I wasn't japanese. When I was seen out on a date with a local girl (before I figured out how things were) I was disciplined by my employer and ordered to stop seeing her. So it might not meet your test because it's never difficult to dismiss someone if you really want to, but yeah, I've lived as a minority. An extreme minority, in fact.

I was also an assistant prosecuting attorney for five years. My opinions come from some considerable experience with criminal jurisprudence.

I'm not a prosecutor anymore, but this isn't something I'm horribly upset about either. I'm not gonna lose any sleep because a scumbag who hurt an innocent person gets a longer sentence for his crime. I'm on the side of innocent victims, regardless of the reason a crime was committed against them. I think the philosophy behind 'hate crime' laws is wrong, but as someone else noted below there are good intentions behind it.

The crime you mention is a terrorist act aimed at millions of people just because of their cultural and religious identity. It is far, far worse than simple vandalism.

171. Motive has always been factored into why a crime was committed...
Otherwise we wouldn't have things like difference in sentencing for Manslaughter, 2nd degree murder, 1st degree murder, etc.

Intent, pre-planning, and motivation for the crime all are a factor in what you are charged with if you commit a crime, in addition to any sentencing enhancements, all bills like the Matthew Shepard act do is add another option in for DA's, Juries, and Judges to add to a sentence.

The difference between manslaughter and, say, first-degree murder, for example, is not the person's reason (motive) for committing the act, it's strictly their state of mind as it relates to what they intended to do and whether they intended to do it, not why they did it.

that's when you start mixing intent and motive.

The bashing of the skull is the act. That's the crime. The "why" is not required to be proved, only the level of intent.

Turn it around for a minute and you'll see why it's important that motive is not a legal element of a crime:

You're on a jury. The prosecutors have proved beyond a reasonable doubt that Person A planned for months to murder Person B. They give you every planning stage, including maps, the murder weapon with the prints on it...everything. The person is 100% guilty of carrying out the murder, and you have no doubts about it or how it was done or who did it.

However, the prosecution is not able to tell you WHY the person did it. Revenge? Money? Snuffing out a witness to another one of their crimes? The prosecution can't tell you WHY.

Do you let that person walk, or do you reduce the sentence based on the inability of the prosecution to tell you WHY it happened?

Indeed, some are considered "spur of the moment" acts, which usually involve a lesser charge and sentence, an obvious example is the "gay panic" defense, which I believe this bill eliminates as a valid defense, and indeed would backfire on the defense themselves, as a similar defense backfired on the killer of Angie Zapata.

And, for the record, I'm in favor of long, harsh sentences for anyone who commits an act of violence against another person, including the death penalty in most, if not all, murder cases. Interestingly, I have talked to many people who are in favor of harsher sentences if motive can be proved, but they recoil at my position of true life sentences without the possibility of parole for any and all violent crime and of course the death penalty as well. I think the across-the-board strict sentencing is tougher than anything offered by this current topic, and it's based on longstanding legal doctrine dealing with elements of crimes.

That's what you "a murder is a murder" people can't seem to grasp. That simply "killing the wrong victim" isn't the trigger to charge a hate crime. It's the provable motive that has to be proved to a JUDGE OR JURY BEYOND A REASONABLE DOUBT to reach the level of a hate crime.

A murder for insurance proceeds has always been worse than a murder in a heat-of-passion bar-fight.

A murder or beating to "send a message that we don't want no fags around here" is worse than a murder or beating in a bar-fight.


Why is that such a difficult concept to understand?

Your two examples are about intent, as well, which is covered in the degree of murder, or manslaughter.

It has nothing to do with the "why" of the crime. Your two examples differ in the amount (if any) of planning and forethought to carry out the act, not "why" a person carried out the act.

2.6-2 Motive

Revised to December 1, 2007

The law does not require that the state, in a criminal case, prove a motive, because it is not an element of the crime. It is not necessary for the state to prove what reason the defendant may have had for committing the crime charged.

Because crimes are generally committed for some motive, evidence of a motive may tend to prove the guilt of a defendant. In the same manner, if there appears no adequate motive on the part of the defendant to commit the crime, that may tend to raise a reasonable doubt as to the guilt of the defendant. <Identify the evidence introduced as to motive.>

If the existence of a motive can be reasonably inferred, that may tend to prove the defendant 's guilt. If no motive can be inferred, it may or may not raise a reasonable doubt as to the guilt of the defendant. If the absence of a motive does not raise a reasonable doubt that the defendant is guilty, then the fact that the state has not proved what the defendant's motive was does not prevent you from returning a verdict of guilty.


You'll notice the last sentence, which could end up causing huge problems in the legal system (i.e. guilty going free) if we were to ever require motive to be proved in court. If the state couldn't prove the motive (which they are now NOT required to do) but proved all other elements, then in that scenario, they person could walk. These legislative efforts to criminalize motive could backfire in court all the time.

Ii is not merely a matter of motive or intent. By your logic, murder and theft should be seen as the same crime since the only different is the intent or motive - the one person wanted to kill someone and the other person wanted to rob.

Hate crimes are crimes against all people in the targeted group. How people here can fail to see that - or deny that they do for whatever reason - is a mystery.

Yes, if a motive can be proved, the charge can be elevated to a hate crime by way of intent. Otherwise, the regular crime of murder/assault can stay as is. The defendant won't "go free" . They will merely be charged with a lesser offense - assuming all other aspects can be proved.

I am pointing out the fact that if you introduce such an element, it can have equal weight either way in a jury's (or judge's, in the case of a bench trial) decision to reduce a charge or sentence, or even determine that the prosecution didn't prove their case in chief.

Like I said, things are a little more complicated than that.

Where hate bias can be proven, it should be used. That's not to say straight people should go to jail for bumping in to a gay man on the street or for "picking on the wrong guy" as our resident "attorney" said up-thread.

Are you least bit worried that innocent people will be killed with no chance to later prove their innocence? That is crazy! Especially in a trial system that is more about winning then finding out the truth. Also a system where rich or well off people can afford a better defense then someone who is poor.

Uhm, actually, no that's not necessarily true, indeed, many are motivated by things like greed(robberies for one), and there are many other motivations as well. Even crimes that are motivated by hate, things such as envy, revenge, etc. are usually against a single individual or a small but specific group of individuals, oddly enough, people usually related to the killer, or at least known to them. Bias crimes are in a different category of hate, one that is much more impersonal, and yet much more dangerous, people who commit such crimes generally only knew the victim briefly, if at all, and targeted them based on some specific trait that is common among a certain group of people, usually of a specific protected class(race, religion, sexual orientation, etc.)

In addition, there are still areas in this country where, while you probably can't get away with outright killing a GLBT person, the chances are, you will get a slap on the wrist, and in some cases won't get caught at all. Think of what happened in the 1960s, with all the KKK members, some of which are still rotting in jail today, for terrorist activities, but they are sitting in Federal Prison, for federal crimes, because local and state authorities simply couldn't convict them of their crimes because it wasn't considered a big deal to kill or terrorize black people in certain areas of the country.

This was an expansion of Federal power, absolutely, but it was also sorely needed, just like the Matthew Shepard act is sorely needed today.

IMO, and I admit there are those that disagree the Dems are not at all in the majority, false flags are confusing the numbers, fully one third or more of elected Democrats are no such thing and they know it. The most obvious are the corporate infiltrators. Namely the DLC. But there are others. Be discouraged by the infiltration but take comfort in the fact that that shite will not be typed by progressives here.

I think I know you from a more specifically progressive board that is dear to my heart, You would not likely remember me as I am not a prolific poster anywhere I participate. But if you do :hi:
