Bomb Material Found in Marine's Luggage
Source: News 14 Carolina

BOSTON -- Massachusetts state police arrested a Marine on Sunday morning that was trying to bring bomb-making materials onto a flight headed for Charlotte.

Officials say Cpl. Justin Reed, of Jacksonville, N.C., was booked on US Airways Flight 877 to Charlotte. The 22-year-old arrived in Boston on a flight from Las Vegas.

Screeners say they found the bomb-making materials and a gun and ammunition in his checked baggage. Reed was charged with possession of an infernal machine and possession of a concealed weapon in a secure area of an airport.

Although the "quaintly archaic term 'infernal machine'" is not defined by the statute, and "is not comprehensible to a person of ordinary intelligence," the Court held that the language of the statute does connote "something that constitutes an individual object." To hold otherwise would expose an ordinary citizen to a ten-year prison sentence for possessing 'items that have legitimate social utility other than as destructive weaponry -- such as gasoline or kerosene, old rags, matches, and empty bottles stored in his garage or basement."

The statute (M.G.L. c. 266, § 102A) prohibiting the possession of an infernal machine requires proof of a single device, rather than separate detached parts that require assembly to be operable.

Infernal machine is a specific term in Massachusetts law. The term probably goes back to colonial days.
It's defined in Chap. 266 Sec. 102A of the Massachusetts General Laws:

"CHAPTER 266. CRIMES AGAINST PROPERTY

Chapter 266: Section 102A. Infernal machine; possession; definition; notice of seizure

Section 102A. Whoever, other than a police or other law enforcement officer acting in the discharge of his official duties, has in his possession or under his control an infernal machine or a similar instrument, contrivance or device shall be punished by imprisonment in the state prison for not more than ten years or in jail for not more than two and one half years, or by a fine of not more than one thousand dollars, or by both such fine and imprisonment, and the said machine, instrument, contrivance or device shall be forfeited to the commonwealth. The term “infernal machine”, as used in this section, shall include any device for endangering life or doing unusual damage to property, or both, by fire or, explosion, whether or not contrived to ignite or explode automatically and whether or not disguised so as to appear harmless. Notice of the seizure of any such machine, instrument, contrivance or device shall be sent forthwith to the commissioner of public safety and the article seized shall be subject to his order."

The news article actually didn't say that he was a fresh returning veteran. Maybe he was. But maybe he was a dope who picked trophies at some base he trains at here in the US. There was nothing to suggest that it was war trophies in the story I read. Maybe they were, but then maybe not. No one ever looked at my luggage when I left a US base, maybe things are different now. What they did say was that he was carrying bomb-making material, a gun and ammunition in his luggage.

Call me cynical, but I think we just saw Napolitano's rear-end being pulled out of the ringer. The timing was convenient for her and the DHS report.

If it was a bra or thong, I'd say yes, that's a Vegas trophy.

A gun? Well, that might be a trophy from a war zone, but the story didn't mention the source of the gun.

Ammo? The only thing that makes sense for a trophy is maybe a deactivated piece of ordnance, not anything live.

Having a gun in checked baggage without declaring it is probably bad news for this (soon-to-be-ex) Marine.

21. Another One Who Thought He Was "Smart"...
Not long ago I read of a local who was nailed at the airport trying to sneak a gun aboard his checked baggage...the dude thought that if he hid it inside of clothes and in a leather case that somehow the x-rays wouldn't see it...and claimed he had done this "dozens" of times before. All it takes is just once. Just cause you don't always see them checking the bags doesn't mean they aren't...especially in the bigger airports that have far more sophisticated and obtrusive detection methods now. The fact he made it through security in Vegas is more damning than his being caught.
