Gov. Sarah Palin is not complying with state law to fill a Senate vacancy by submitting three names at once, according to a legal memo.
Palin spokeswoman Sharon Leighow told a reporter Tuesday that Wayne Anthony Ross, the governor's recent appointment to attorney general, had checked off on her process.
Ross, who has not been confirmed by the Legislature, told Rhonda McBride, a KTUU reporter, that he approved Palin's process.
Sen. Hollis French, D-Anchorage, asked the Legislative Affairs Agency to evaluate whether Palin was working within the bounds of state law.
The opinion states the governor is to appoint a new senator, whom the Democrats can confirm. Offering a list of three potential candidates falls short of an appointment.
"The short answer is that the governor's presenting more than one name at a time to fill a vacancy in the state Legislature does not comply with state law," the legal memo stated.
Juneau Democrat Sen. Kim Elton resigned mid-session to take a job with the Obama administration. In such a case, the governor offers an appointment, which must be confirmed by Senate Democrats.
