36. I don't think the USSC will take the case...
Elections of reps and Senators are STATE rights and not a Constitutional issue. For those who say they will because of Bush v Gore, I disagree for many reasons. Leaving the legal reasons aside and just addressing the political, there is NO benefit for the USSC to take this on, it does not change who is in the majority in the Senate, it does not change which party is in the Presidency.

59. Norm can file whatever he wants to whomever for as long as his money,...
and that of his benefactors, holds out, it does not affect when Franken can be seated. Once the Minnesota Supreme Court rendered a decision either by hearing the case or refusing to hear it, the State appeal process, under statute, is at an end and the Senate can seat him having honored the State's electoral appeal process to it's conclusion.

67. I think the Dems will call their bluff once the State appeal process...
has been exhausted and Franken is declared, yet again, the successful candidate. I cannot find where, once the contest has entered the Courts, the signature of the Governor is required. This is what I did find as it relates to the Minnesota Supreme Court decision:

"A copy of the decision must be forwarded to the chief clerk of the house of representatives or the secretary of the senate, as
appropriate."

It makes no mention of the need to forward the decision to either the Governor or, indeed, the Secretary of State, I am sure, though, a copy is forwarded to them as a courtesy.

WWIII, I read somewhere that it meant the repubs would hold up the rest of Obama's proposed appointees. If that is, indeed, what WWIII means I suspect it will be a spectacular failure, not unlike everything else they have tried recently. They have a pitiful approval rate in Congress somewhere in the 30s due to their current obstructionist tactics. To pull "World War III" can only help, not hurt, the Democrats, imo.

19. Two caveats:
1) I believe Minnesota law says a certificate of election cannot be issued until all litigation in the state courts is completed. The only state court left is the Minnesota Supreme Court.

2) In a recent ruling, the Minnesota Supreme Court noted that under the U.S. Constitution, the Senate has the authority to seat Franken any time they choose.

64. There is nothing in the Statute regarding the need for a signature from ...
the Governor once the Minnesota Supreme Court has rendered it's decision:

"A copy of the decision must beforwarded to the chief clerk of the house of representatives or the secretary of the senate, as

The Governor is listed among those who are to be forwarded the decision although, I am sure, it is done so as a courtesy.

Also:

"Subd. 6. Not a limitation. This chapter does not limit the constitutional power of the house of representatives and the senate to judge the election returns and eligibility of their own members."

66. I did see the msg calling Franken a clown. May I remind people - it was
1999 and it looked like the Repubs had picked Bush. Drudge ran a story on his site saying that aides of one of the candidates were busy rounding up photographs of their candidate - he reported that supposedly one was of a candidate dancing naked on a table with only boots on.

Now we know that it wouldn't be Gore, Bradley, Buchanen, Bauer, Keyes, or some of the other candidates in 2000.

Talk about a clown. That was about the time that his team was also locking down the AF reserve records.

Now, Al went to Iraq more times than Bush, most likely with less protection than Bush, and Franken didn't have to do it.

And he made them laugh with the humor of a professional - not attempts to crack a joke with a shaking up and down snort in boring frat boy style where the laughter is polite or orchestrated.

Al is a passionate guy and extremely intelligent. I'm hoping he will attempt to lead like Wellstone did.

I would like to be in the Senate and get to hear Franken in his light moments - his quips are as fast as them come. He is a student - I'm sure he's continuing he self teaching, tutoring, and coaching that they all go through. We'll benefit.

He's a comedian - it is not the parallel of clown. We know what a clown is in the way it is meant for politicians.
