Legal War Story Note: My dad was an attorney and once represented the wife in a divorce case.

The husband was on the stand. On direct examination, the husband's attorney had established that the man was violent.

Pass the witness.

Dad starts cross examination with: "When did you stop beating your wife"?

Opposing counsel: "Objection!"

Judge: "Overruled."

Answer: "Oh, about six months ago."


(Opposing counsel continues to blow steam out his ears and turn purple.)

Bit of a law school lecture here: Why was this question & answer admissible?
Two reasons: 1)The husband's attorney had discussed the subject of violence by the witness on direct examination. This is called "opening the door" in legalese.
2) Leading questions are allowed on cross-examination. Leading questions are questions that presume an answer. Therefore the question was proper and the answer was admissible, and opposing counsel couldn't do a damn thing about it.

Dad said that that exchange was the high point of his career, over forty years of practicing law!!!!
He got to ask THE leading question that lawyers dream about, and get an admissible answer!!

He passed on in the year 2000. He led a long and interesting and busy life, and was nearly 89 when he died. He was born in 1911, went to law school on the G.I. Bill after the war, at night from 1948-51, graduated from South Texas College of Law, passed the bar in 1951, and retired several times. Mom typed for him until I got old enough to do it for him. Then I was his cheap labor and I got chained to the old IBM (just joking).


Then I became a court reporter, did that until I was burned out, and I went to law school at night while working at the courthouse, same school, got my J.D. but didn't pass the bar. Took me five years. However, I looked for a paralegal job recently, for over a year, and had no luck. So now I'm a bum and making music for fun!!! Workin on my piano chops!!


He was a cool guy with a very dry sense of humor, and I laugh a lot remembered the funny lines he came out with. He had a lot of street smarts. He was also a pipefitter and a union organizer, before he went to law school. Worked at a stinkin' refinery for 30 years. Mom had some funny lines too, and I don't know how many of them were East Texas expressions or what.

I was grown before I realized I was raised by a couple of comedians.
