When the Senate and House Judiciary Committees start looking into the political interference with the Foreign Corrupt Practices Act investigations against Halliburton, we'll be moving into endgame.

1. Do you think Haliburton saw the writing on the wall
and decided their move was necessary?

I sure hope this has teeth.

4. From the Latest Halliburton Annual Report
We entered into various agreements relating to the separation of KBR from us, including, among others, a master separation agreement, a registration rights agreement, a tax sharing agreement, transition services agreements, and an employee matters agreement. The master separation agreement provides for, among other things, KBR’s responsibility for liabilities related to its business and Halliburton’s responsibility for liabilities unrelated to KBR’s business. Halliburton provided indemnification in favor of KBR under the master separation agreement for contingent liabilities, including Halliburton’s indemnification of KBR and any of its greater than 50%-owned subsidiaries as of November 20, 2006, the date of the master separation agreement, for:

- fines or other monetary penalties or direct monetary damages, including disgorgement, as a result of a claim made or assessed by a governmental authority in the United States, the United Kingdom, France, Nigeria, Switzerland and/or Algeria, or a settlement thereof, related to alleged or actual violations occurring prior to November 20, 2006 of the United States Foreign Corrupt Practices Act (FCPA) or particular, analogous applicable foreign statutes, laws, rules and regulations in connection with current investigations, including with respect to the construction and subsequent expansion by TSKJ of a natural gas liquefaction complex and related facilities at Bonny Island in Rivers State, Nigeria

7. in a way, what they are doing now, the steps they are taking
to insulate themselves, is similar to insider trading, isn't it?

Bastards are taking steps to protect their interests when this all comes crumbling down.

16. Am I getting this? Halliburton moves to Dubai? KBR stays here?
Edited on Sun Mar-25-07 12:58 PM by higher class
Halliburton to Dubai except for a token part that stays here? What part of Halliburton is covered by the Deleware registration (licensing or whatever the term is that covers culpability within the U.S.)?

Does it all mean that if a soldier or his family or employees wanted to file a lawsuit or if our Congress wanted an investigation - we would have to hire a Dubai lawyer?

5. How Can the DOJ/Treasury Credibly Freeze Iranian Assets If...
... they cannot bring an FCPA investigation to conclusion involving a politically-connected Houston-based company?

In other words, if they cannot untangle an American company's finances to "follow the money" on a foreign bribe, how can they credibly assure the American people that they can enforce sanctions against Iran?

Maybe the answer lies in the amount of actual political will to do each task.

15. That is a great & crucial talking point for the 2008 elections, CGA!
Good one!! And it is certainly one thing that is going to have to come up in the general election, if we get a candidate that isn't DLC!

9. Leahy has long wanted to go after Halliburton.
In fact, that's why Cheney told him to go fuck himself. Leahy had been railing against Halliburton.

11. I think he'll feel great while he's running them, though
sometimes I seriously worry about his blood pressure. I'm awfully happy, however, to be represented by him. Always have been. He's an anti-corruption force, and he's not owned wholly or in part, big oil, AIPAC, big Pharma, or anyone but us Vermonters.

13. Undoubtedly. And a damn good tag team they make.
And Conyers certainly has a calmer demeanor than Pat. I am getting really excited and hopeful about all this. You must be thrilled.

14. Thrilled?
Yeah, you could say that.

Back when I first suggested the political interference with the Halliburton FCPA investigation, some reporters were hesitant to run with that.

Now, it's a very, very different story.
