Will Obama's AG enforce contempt of Congress citations?
Remember that Congress has held Harriet Miers and Joshua Bolten in contempt for refusing to testify, and the House Judiciary Committee voted to hold Karl Rove in contempt for the same thing.

But they still have not testified. Mukasey refused to enforce it, saying he agreed that they don't have to show up.

So the house had to take it to court, and the case is still pending.

But now with Obama in charge, is the lawsuit moot? Will Obama's AG simply send U.S. Marshals after these folks?

The first thing the House did this session was to renew the contempt proceedings against Miers and Bolten, so they obviously want to push this thing.

You read that right, they think it is cause to hold up confirmation and it appears that they can do it. An AG that won't prosecute crimes, yep sounds legal.:sarcasm:

4. I'm not sure the Rethugs have the votes.
They'll probably try to filibuster, but get clotured.

At least that's what I hope - someone like Snowe or Collins breaks ranks.

Holder is popular, and he did a bang-up job at his confirmation hearing - he actually answered questions like "Is waterboarding torture?" straight up, which is quite refreshing when compared to Gonzo's oath-induced amnesia. He's got a lot of popular support, and the Republicans are likely to get ripped on if they continue to hold his confirmation up without a good reason (and no, waiting for an agreement not to prosecute the Bushies is not a good reason in the minds of the public.)

I'd say Holder has a 65% chance of getting confirmed this week following a successful cloture vote, another 20% chance of being confirmed later after Obama leans on some recalcitrant GOP Senators, and 15% chance his confirmation will be successfully blocked.

3. Yes. Holder will enforce the orders.
The head of OLC will back it up by stating that there is no executive privilege in play with Rove et al and thus no reason in the world why the AG should stand in the way of a valid subpoena from Congress. Go get em Conyers!
