DALLAS (AP) — Three Texas voters have sued to block Gov. George W. Bush from possibly becoming president by challenging running mate Dick Cheney's Wyoming residency status. The lawsuit was filed hours after a similar lawsuit was dismissed in Florida.

The suit filed Monday claims Cheney is a resident of Texas and that he and Bush, therefore, shouldn't be awarded the state's 32 electoral votes. The lawsuit cites the 12th Amendment, which prohibits the president and vice president from living in the same state.

''Someone cannot be a resident of two states simultaneously,'' said Bill Berenson, the Fort Worth attorney representing three Dallas County residents who are suing Bush and Cheney. ''If Mr. Cheney wanted to run for political office in Wyoming he would be prohibited from doing so. Some of Wyoming's statutes state that.''

Cheney lived in Texas until he changed his voting registration to Teton County, Wyo., on July 21. He or his wife has owned a home there since 1993. Cheney also has a home in McLean, Va.

Last week, Cheney put his Highland Park home on the market for $3.1 million, Berenson said.

A call to the Bush-Cheney campaign was not immediately returned.

A lawsuit filed in last week in Florida that made similar claims about Cheney was dismissed on Monday. Berenson said the Dallas County lawsuit was filed because the merit of the basic claim must be sought by residents in the county where Cheney resides.

The suit claims that Cheney holds a Texas driver's license listing his Highland Park address and that, on Feb. 22, he changed his personal records at the Texas Department of Public Safety and again listed the Dallas address.

78. No, it was not illegal. They would not have been able to accept Texas's electoral votes.
The false residence in Wyoming was set up to allow them to get Texas's electoral votes, but it is perfectly legal for a Presidential and Vice Presidential candidate to come from the same state. It would be stupid, but they were almost dumb enough not to catch it.

In theory, this might deny a vice presidential candidate with the most electoral votes the absolute majority required to secure election, even if the presidential candidate is elected, and place the vice presidential election in the hands of the Senate. In practice, this is rarely an issue, as parties avoid nominating tickets containing two candidates from the same state. In one notable case, former Wyoming congressman Dick Cheney had moved to Texas to serve as CEO of Halliburton Company, but reclaimed residency at his Wyoming home before accepting the 2000 Republican nomination for Vice President, alongside presidential nominee and Texas governor George W. Bush.

the brilliant book about Cheney in the Vice Presidency, and you'll learn that Cheney had his house removed from any kind of map, like google earth.

You really think Cheney would have had any residence of his where anyone could find it?

You are thinking of 1 Observatory Circle. His house on Chain Bridge Road doesn't show up because it was a vacant lot for a long time. He had the old house torn down and this new house built.

A lifetime in the Washington area enables me not to confuse DC and Virginia.

He currently dwells in the Naval Observatory house - that's One Observatory Circle - that's the official residence of Vice Presidents. He has no house in McLean, not any more.

And it wasn't on Chain Bridge Road - it was on a street that sounded a lot like Chain Bridge Road, which is a major thoroughfare here, but the name wasn't famliar to me. I mapquested it and it was a tiny street, far from Chain Bridge.

Read "Angler," by Bart Gellman. The house is written about quite extensively. The house still stands.

the tax records are in no way probative. The Observatory Circle address leads you to think that the owner of some residence is Dick Cheney? Really? Did you know that clicking on the link to the Fairfax Country tax records that is withn the link you so kindly provided me above leads to a blank page?

I think you've been suckered.

And the dailykos article that was referred to quotes a caterer who claims he worked at the Cheney residence.

I say it's all nonsense, and that house - well, I don't know who it is, but someone's playing tricks with "tax records."

You might want to do better research than believing what you read online. The Cheney residence was sold, and they have not built a new one here - one place they really don't want to be after January 20 is in the DC area.

This has been, though, entertaining.

You got a link for your claims? And don't just say, "Go read 'The Angler' By Whoever" One, I took those pictures. The day I took the first set of pictures I asked a gardener working at the property across the street if he knew who was building the house. He said, "The Vice-President". Two, the building permit similarly had the owner's information, "taped over". Three, there is this article in the Post that says that Dick Cheney will be moving to Mclean, here:

"Cheney tore down the previous house, we were told, but left the lot vacant -- much to the consternation of the exceptionally well-heeled neighbors -- when he moved into public housing at the Naval Observatory off Massachusetts Avenue NW.

And, yes, to answer your question, they sold that house after he became Vice President. Within the first year, if I recall correctly. It's written about quite extensively in "Angler," the absolutely brilliant dissection of the Cheney monarchy by Bart Gellman. I highly recommend it. When the whip comes down, "Angler" will be the blueprint for the prosecutors.

The architect that is. The two "wings" that jut forward are in the style of colonial Virginia outbuildings, as are the chimneys. I guess the main part is supposed to be a styled in the plantation manors of that era. It's all horribly wrong though. It should be brick. It's all brick in Virginia.
