Special Prosecutor on US Attorney Lam's Firing Is Possible, Legal Experts Say
The next big question for Democrats in Congress is whether to press for a special prosecutor to investigate possible criminal charges against Bush administration officials for removing San Diego U.S. Attorney Carol C. Lam while she was conducting a sensitive corruption investigation.

While some experts agree there is enough ammunition to demand an investigation by a special prosecutor into obstruction of justice, others question whether the Democrats would want to, given that only the Attorney General has the power to appoint an independent counsel.

It's the Justice Department itself that would, by law, have to appoint a special prosecutor to, in this case, investigate itself.

That's because the law that allows Congress to authorize an independent counsel expired in 1999 following Independent Counsel Kenneth W. Starr's investigation into the relationship between President Clinton and Monica Lewinsky.

4. Fitz couldn't streach his case THAT FAR to cover the firing of USA's.
For HIM to have authority and the protection of "a Special Presucutor" the casehas to at LEAST fall within the bountries of his charge.

Great idea, but sorry, it won't work.

5. Duh
The point the previous poster is trying to make is that Fitz should be appointed as the special prosecutor in this (new) case, not extend his old, unrelated case to cover these unrelated crimes.
