I mean really when you look at the whole situation Wal-Mart should be held responsible for this type of behavior.


They placed that kid where he was AND they caused the "frenzy" in a sense. Yes, we a a human race should be looking after one another but how the heck is someone going to be held responsible when they themselves would have been placed in danger.

Maybe I'm looking at it wrong.

anyone can help me wrap my head around this one?

1. to my mind it is a bit like going after
a driver of a small car hit from behind and pushed into a sidewalk. the people in front had no way to stop or control all the people behind them shoving to get in to store. there should have been some control exersice but it seems that that store wanted people "fired-up" to buy and let it get out of all control.

2. It could have been one or two people that caused the rush.
Any one in front of the stampede would have to keep moving or be trampled too. How can you blame a crowd for being created and manipulated by irresponsible marketing.

7. It's like the reverse of yelling fire in a theatre.
Instead of a mass of people trying to funnel thru one door at the same time to get out, you have an intentionally created frenzy where a mass of people try to funnel or push their way through one door at the same time.

Isn't it funny that we have a law that states you can't yell 'fire', specifically created to avoid crowd panic, and yet we have stores puposefully creating crowd panic .

I still don't understand why they didn't hand out numbers.

9. Nowhere does the report say they are arresting shoppers.
And they'd be lazy, stupid, and incompetent if they didn't question some of the shoppers.

Maybe you read something I didn't. :If so, please point out where it says police and investigators are "going after" the shoppers. :shrug:

15. Obviously, you have never been to a rock concert...
the psychology of crowds of people is very interesting.

While those who did the actual trampling maybe guilty of stepping on another human being, the real fault should be placed squarely at the feed to walmart.

Those in the front of the line are bullies, period. those in the middle usually get swept up and have no idea what is underfoot. those in the back, hopefully were the ones that saw what happened and tried to help.

letting people into a store en mass without crowd control so walmart can make the nightly news with the yearly "crowds bursting into the store" shot is criminally libel.

There have been stories over the years of people being "banged up" or suffering "slight injuries" but this one event brings to mind the famous WHO concert where the concert goers, of an over sold show (how many wii's did chinamart have on had? 3?) were crushed do death when trying to enter the concert.

back then much like what should happen today, the fault was found with the lack of crowd control and management.

but like everything else in our current bizarro land of corporate lazafaire and corporate welfare, the prols will be held accountable, because they are easy targets with no resources to adequately defend themselves. Why go after a conglomerate and lose? (fill in your best exxon valdez settlement story here).

If anyone has a clue, a class action lawsuit should be brought against walmart and the big box retail industry in general. walmart is the poster child for this crap happening, but it covers a wide range of stores that practice similar no crowd control procedures.

11. I've been in near-stampede conditions
...at some rock concerts. I've had people fall in front of me and all I've had to do is turn around and yell at the people behind me to hold up while they regained their footing. Anything else is negligence.

be held liable in a civil suit, but it's up to the deceased man's family to bring the suit. Some of the shoppers deserve to be held responsible, too. Many of them refused to stop shopping even after the store announced it was closing because of the death.

And it's not as if they were waiting in line for food or other necessities. We're talking about people who worked themselves into a fatal frenzy over cheap TVs and video games, and then kept right on shopping after learning their actions had killed a man.

13. If the shoppers had been wealthy people, you can bet the police wouldn't be going after them.
They can go after poor people who can't afford lawyers easier than they can wealthy people with an army of private attorneys on retainer.

WalMart bears some culpability, but that doesn't excuse the crowds behavior.

The police should be investigating this tragedy, and if they and/or the AG/DA's office feels the evidence warrants it, any shopper(s)charged should be prosecuted and fined/imprisoned to the full extent of the law.

Seriously.

Yes Mal-Wart marketed hype, but the shoppers did not need to behave "like savages". Both personal and corporate responsibility could have prevented this awful situation.
