How could the vote be 42-13?

How could the vote be 42-13?
I thought Democrats only hold 48 seats. Used to be 49 but Obama just resigned his seat yesterday. How could there be fifty five votes? Was Bernie Sanders allowed to vote in this, and I suppose Lieberman was allowed a vote as well.Still that would only be fifty votes...I don't get it. :shrug:
