My question about Prop 8 and similar props: what's the legal definition of 'male' and 'female'?

My question about Prop 8 and similar props: what's the legal definition of 'male' and 'female'?
I'd love to see someone challenge these idiotic asinine evil "marriage protection" bullshit proposals on the basis that, as far as I know, neither the US nor any other country, has a legal definition of what is 'man' and what is 'woman'.

I wonder if a gay couple, say two men, could show up at the courthouse and one of them just mark himself down as female while the other does male.

Is a judge gonna force them to show their genitalia?

Where do hermaphrodites fit into the cosmic "marriage protection" rubric?

Does the government have the right to tell you what gender you are?

2. Actally there is a legal defination of male/female based on sex organs at birth
as recorded on the birth certificate. Thats why a person who has a sex change has to go to court to have his sex changed legally. So unless their is court documentation showing that the sex change happened then the sex is determined on the birth certificate. Thats why you have to show the birth certificate when you seek a marriage license. Same with the people born with 2 sexes, whatever sex the doctor puts down on their birth certificate is how they are seen in legal terms.

4. I'm sure there are a bunch of genetic abnormalities that put male and femaleness into question
for example complete androgen insensitivity syndrome (CAIS) where someone is technically XY (a man) but testosterone doesn't create any secondary sex characteristics so on the outside that person appears to be a woman. You would never know that person isn't a woman unless you did genetic testing...so who can that person marry?

Gee wonder why they never discussed this problem in the bible :eyes:
