gay marriage question
has there ever been a case brought before the US Supreme Court, similar to Loving v VA?

can we get this out of the states? its a civil rights issue.

1. No but ...
California may be able to bring a case up if Prop 8 passes. But then again, a Roberts court may just let it stand.

3. Anyone married in California
(whether or not prop 8 passes), in Massachusetts, in Canada, or any other jurisdiction in which the legal status of marriage can be created could bring a case could be brought today by anyone who is married and who is living in a state that does not recognize a marriage that was legally valid in the state (country) in which it was created.. (In my opinion) it would not be a helpful thing to do.

No.

The time is not right. Although virtually identical issues are involved, and the outcome should be the same, it is likely with the current Supreme Court that the outcome would be different. When there is a negative decision, it is harder to overturn.

The day is coming - and I expect that is the way the barriers will fall once the composition of the Supreme Court is more balanced and there are a few more states which have marriage laws. When the time is right, I have just the case for them. Married 27+ years, with the marriiage recognized by my faith community for 14+ years, and by a governmental entity (Canada) for 3+ years.
